Delaware Blackjack Sites: Legal Online Blackjack in Delaware

Delaware does not license online casino operators the way most states do. There is no application process where DraftKings, BetMGM and Caesars each pay a fee and launch a competing product. Instead, the Delaware Lottery runs a procurement. It issues a request for proposals, picks one technology provider, and signs a contract.

So when people say Delaware has three online casinos, that is accurate as a matter of licensing. As a matter of what you actually play, it is one product with three logos.

The lottery’s authority comes from Title 29, Chapter 48 of the Delaware Code. Its internet-specific rules are set out in 10 DE Admin. Code 206, the Internet Lottery Rules and Regulations, adopted under 29 Del. C. Section 4826. Those regulations define an authorized game to include blackjack and explicitly permit gaming tournaments in authorized games when the director approves them. The bipartisan Internet Sports Lottery Legislative Working Group, co-chaired by Cooke and Bush, had concluded Delaware should allow up to six mobile operators, and Cooke argued Delawareans were still driving into Maryland, Pennsylvania and New Jersey to use their preferred apps. Both Rush Street Interactive and the Delaware Lottery testified against HB 365. The lottery’s position was that opening the market would reduce state revenue, and state fiscal officers estimated Delaware would lose roughly $3 million a year in sports betting revenue if exclusivity ended. Lottery Director Keeley also raised the possibility that Rush Street could sue for breach of contract or demand renegotiation.

It is worth being precise about what HB 365 would and would not have done. It addressed online sports betting only. It would not have opened Delaware’s online casino market or added new blackjack operators. But industry observers noted at the time that bringing more operators into the state for sports betting could eventually create pressure to do the same for online casino games. A comparable bill has not become law since.

HB 335 matters less than it looks for blackjack players. The bill targets iLottery draw games, not internet table games, and it would not have changed anything about how you access online blackjack in Delaware. Sponsors describe it as restoring a small-business protection built into the original 2012 act but not honored in practice by the lottery’s iLottery rollout. See the House Bill 335 bill detail.

Most states set a percentage tax on operator revenue. Pennsylvania taxes online slots at 54 percent and online table games at 16 percent. Delaware does not work that way, and any source quoting you a single Delaware online casino tax rate is oversimplifying.

Because Delaware’s online games are lottery products, the money runs through a distribution formula rather than a tax on a private operator’s profit. Under 29 Del. C. Section 4815(e), gross revenue from the internet video lottery and internet table games is accounted for to the state treasurer, and all proceeds net of money returned to players go into a special account called the State Internet Lottery Fund.

From that fund, the director first pays the costs of operating and administering the internet video lottery and internet table games. After that, the first $3,750,000 of proceeds in each fiscal year goes to the State Lottery Fund for the benefit of the state. Only then does the remainder get distributed according to the same formula used for the land-based games.

The rest flows to the casinos and the technology vendor. The practical takeaway is that Delaware taxes online blackjack far more lightly than online slots, which is the mirror image of the Pennsylvania model and one reason Delaware’s table game numbers look healthy relative to the size of the state.

The Delaware Lottery publishes the real distribution figures. In fiscal 2025, total online net gaming revenue across all three sites was $85,491,118. Of that, the state share came to $17,563,336, purses received $3,680,203 and seller commissions totaled $24,661,626, with the balance covering vendor and administrative costs. The state share worked out to roughly 20.5 percent of net gaming revenue.

Fiscal 2026 was a much bigger year. Total online net gaming revenue climbed to $135,928,894, up about 59 percent year over year. Internet table game handle rose from $1.22 billion to $1.72 billion. Internet table game net revenue rose from $27.08 million to $34.63 million.

The state’s fiscal 2027 reporting is now underway. In July 2026, the first month of the new fiscal year, Delaware players wagered $137.5 million on internet table games, producing $3.27 million in net revenue, with total online net gaming revenue of $13.44 million and 4,784 new registrations. Yes. The Delaware Lottery states plainly that all winning Delaware Lottery tickets are subject to Delaware income tax, and online blackjack winnings are lottery winnings under state law.

Delaware is unusual in that it does not withhold state tax at the point of payout. That can read like an exemption, but it is not. The liability still shows up on your Delaware return, where the top marginal personal income tax rate is 6.6 percent. Nonresidents who win while playing inside Delaware may owe tax in their home state instead.

Federal rules still apply. For prizes over $5,000, 24 percent is withheld for federal tax. Table games including blackjack generally do not trigger a Form W-2G the way slots do, because the standard reporting trigger requires winnings of at least $600 and at least 300 times the wager, a combination blackjack rarely produces. That does not make the income untaxable. It only means the paperwork may not be generated for you.

Two federal changes are relevant for the current tax year. Under the One Big Beautiful Bill Act, gamblers may deduct only 90 percent of losses against winnings starting with the 2026 tax year, which means a break-even year can still produce a tax bill. A bipartisan bill known as the FULL HOUSE Act has been introduced in Congress to repeal that change and restore the full deduction, but it has not passed. Separately, the reporting threshold for slot machine and bingo winnings has been raised to $2,000.

None of this is tax advice. If you play at volume, talk to a professional and keep session records, because your own records are often the only documentation you will have.

Delaware’s regulations put obligations on licensed agents that no offshore site accepts. Agents must keep current on all payments and tax obligations, pay players and transfer net proceeds to the state lottery fund as required, make their premises available for inspection by the lottery or DGE on a 24-hour unannounced basis without a warrant, and consent in writing to examination of all accounts, bank accounts and records under their control.

Operators must also meet minimum internal control standards adopted by the lottery director, and employees with access to the internal workings of internet lottery equipment must be licensed as gaming employees after background investigation.

Delaware runs a single self-exclusion program covering everything at once. Enrolling excludes you from all gaming at Delaware Park, Bally’s Dover and Harrington, from all three iGaming websites, and from the lottery’s iGaming and sports mobile app. There is no way to exclude yourself from online blackjack while remaining active on the casino floor.

By law, Delaware’s games must return between 87 percent and 95 percent of all wagers on an annual basis, with returns above 95 percent permitted at the lottery director’s approval. That is a floor on payout, not a promise about your session.
