Ask how old you have to be to gamble in the United States and the honest answer depends on three things: which state you are standing in, which game you are playing, and who owns the building. There is no national number. Each state and the District of Columbia sets its own thresholds, and nearly every one of them sets more than one. That is why a 19-year-old can sit down at a blackjack table in Lincoln, Rhode Island, but cannot open an account with the same company’s internet casino, and why an 18-year-old in Iowa can enlist in the Army but cannot legally buy a scratch ticket. This page lists every age by activity, then explains what the number actually means for real money play at licensed online blackjack sites.
Two numbers dominate the map: 18 and 21. The gap between them is not arbitrary. It traces to liquor law, to a 1988 federal funding deadline, and to the fact that a sovereign tribal government need not copy the state around it.
How to read this table
“Casino” means the state-regulated commercial floor, whether that is a riverboat, a racino, a card room or a historical horse racing hall. “Tribal” covers Class III properties run under compact. Where a cell says the number varies, the age is set property by property rather than by statute, so check the specific casino before you drive there. Notes on the Numbers That Surprise People
Four lotteries sit at 21, two states run bingo at 16, and one state puts the racetrack above the lottery.
Four states put their lottery at 21. Iowa was first, in 1994, and the Iowa Lottery still states flatly that players must be at least 21. Arizona followed on June 1, 2003, when Arizona Revised Statutes 5-515.02 made it unlawful for anyone under 21 to buy a ticket or a share, and the Arizona Lottery repeats the rule in its own FAQ. Louisiana moved its lottery from 18 to 21 in 1998 so the number would match the rest of the state’s gaming, and Mississippi wrote 21 into its lottery from the day it launched in 2019. Nebraska is its own case: state law fixes the age of majority at 19, and Nebraska Revised Statutes 9-810 bars anyone under 19 from buying, being given or redeeming a lottery ticket.
At the other end, Maine lets a 16-year-old play beano under Title 17, section 319, which also admits younger children to the playing area with a parent or guardian. Missouri permits bingo at 16. Alaska splits its own charitable menu: bingo is 19, but pull-tabs were pushed up to 21 in 1993 and stayed there, a division the Alaska Department of Revenue still administers.
Ohio needs a correction
Plenty of summaries put Ohio’s bingo age at 16. Ohio Revised Code 2915.09(C)(12) makes it an offense for a charitable organization to let anyone it knows or should have known is under 18 play bingo, and section 2915.11 separately requires bingo game operators to be 18 or older.
Texas is another one people get wrong. The lottery and charitable bingo are both 18, but the Texas Racing Act defines a minor as anyone younger than 21, which makes pari-mutuel wagering a 21-and-over activity in a state where two other regulated forms start at 18. Why the Age Is Not the Same From One Game to the Next
Three forces set every number on that table: an absent Congress, a 1984 highway bill, and tribal sovereignty.
Congress Never Set a Gambling Age
Federal gambling law regulates channels, not customers. The statutes on the federal statutes hub police interstate transmission, illegal business operations and payment processing; none of them tells a 19-year-old in Helena that he may not feed a poker machine. Washington left the age question entirely to the states, and the states never coordinated.
Liquor Is the Reason 21 Won
The single strongest force pushing casino floors to 21 has nothing to do with gambling policy. It is 23 U.S.C. 158, the highway funding provision enacted in 1984 that directs the Secretary of Transportation to withhold a slice of a state’s federal highway apportionment if the state permits anyone under 21 to purchase or publicly possess alcohol.
Once a drinking age of 21 was universal, a casino that pours drinks on an open floor faced an unattractive choice: police a mixed-age room drink by drink, or refuse entry below 21 and be done with it. Nearly all chose the second option, and legislatures wrote that choice into the gaming acts. The exceptions prove the rule. Rhode Island’s casino floors, New Hampshire’s charitable gaming halls and Washington’s card rooms all admit 18-year-olds, and all three grew out of licensing structures where floor liquor service was restricted or arrived later.
Tribal Governments Write Their Own Rules
A tribe is a sovereign government, not a licensee of the state it sits inside. Its gaming ordinance is approved by the National Indian Gaming Commission and its Class III games run under a negotiated compact, as the tribal gaming page explains. Some compacts fix a minimum age; others leave it to the tribe. So the age at a tribal property can sit below the state’s own casino age, above it, or apart from the property 40 miles down the road.
Michigan is the cleanest illustration. Detroit’s three commercial casinos are 21 because state law says so. Bay Mills, Island Resort, Leelanau Sands, Little River, Northern Waters, Ojibwa, Saganing Eagles Landing, Soaring Eagle and Turtle Creek all admit players at 18. Kewadin Casinos, run by the Sault Tribe of Chippewa Indians, dropped its own age from 19 to 18 on March 30, 2022, a change no state agency had any role in. Lottery and Bingo Carry the Lightest Restrictions
Legislatures have consistently treated a $2 draw ticket and a church bingo card as lower-risk than a blackjack shoe. Small stake, slow play, no alcohol, and in the charitable case the proceeds go to a nonprofit. That is why 18 dominates the lottery column above, why Maine and Missouri were comfortable dropping to 16 for bingo, and why no one calls a state inconsistent for running casinos at 21 and its lottery at 18.

West Virginia’s drafting is as blunt as it gets: a person placing a wager shall be at least 21 years of age. Connecticut’s is more interesting, because the same subsection that sets 21 for online casino gaming and sports wagering sets 18 for fantasy contests. Nevada is a footnote here, since its regulated internet product is poker rather than casino table games, and it is 21 as well. Maine authorized online casino gaming in 2025 under LD 1164, but the Gambling Control Unit was still in rulemaking in late summer 2026, so there is no live product and no player age to report. Rhode Island draws the line sharpest
The games are identical. Under the state’s video lottery chapter an 18-year-old may play the machines and the table games at a licensed casino. The iGaming provision added later, section 42-61.2-3.4, bars online play below 21. A 19-year-old can deal into a live blackjack game in Lincoln and then be turned away from the same company’s app in the parking lot.
Three things drive that gap.
The political climate of the drafting years
Lawmakers writing internet gaming bills in the 2010s and 2020s worked in a climate that treated a phone in a teenager’s pocket as riskier than a casino visit, and 21 was the safe number to write.

In practice you enter your legal name, birth date, residential address and usually the last four digits of your Social Security number. Those fields go to an identity verification service that matches them against credit header files, motor vehicle records and other public and commercial databases. When the data points line up, the account opens in seconds and no document is ever requested. When the match is partial, thin or contradicted, registration is held and the site asks for a photo ID and proof of address before it will take a deposit. Legal exposure for the player is usually smaller than the internet suggests. In most states the heavy penalty lands on the operator or the retailer. Nebraska makes it a criminal offense to sell a lottery ticket to someone under 19, and the retailer’s contract can be suspended or terminated. New Jersey treats permitting an under-21 player to gamble on an internet account as a criminal offense aimed at the licensee. Where the player is penalized, the sanction is usually civil or a low-level offense. Montana sets a clean benchmark: its statute subjects a person under 18 who knowingly gambles to a civil penalty of not more than $50 in justice, municipal or city court, while the adult who allowed it commits a misdemeanor. Several casino states add a fine and, in some, a driver’s license suspension. A first offense rarely produces a criminal record, but it can produce a citation, a permanent bar from the property and a note in a shared industry database. A tribal 18-and-over floor rule does not reach a state-licensed internet product, and no tribal ordinance lowers the age for a real money account in a regulated state. At 18 or 19 in a state with an 18-and-over tribal floor, that floor is your legal option and the app is not.
