Delaware Lottery: The Regulator That Also Operates the Casino

What the Delaware Lottery Is

Nothing else in the American market works this way, and the difference reaches down to the promotions and the rules on the felt.

The Delaware Lottery, an office inside the state Department of Finance, is the operator of record for every hand of internet blackjack dealt in the state, and the three casinos whose logos sit on those websites are its agents. Delaware also got there first, launching a full casino product in November 2013, which makes it a useful benchmark for anyone comparing how online blackjack sites get authorized.

Scale is the other half of the story. In the fiscal year ended June 30, 2026, Delaware’s three internet casinos produced $135,928,894 in net gaming revenue and registered 62,940 accounts. Pennsylvania’s licensed operators cleared more than that in a fortnight.

Gov. Sherman W. Tribbitt signed the act creating the state lottery on May 31, 1974, and sales began the following year. Under 29 Del. C. 4802, “A State Lottery Office shall exist as part of the Department of Finance and shall be administered by a Director responsible for the operation of a state lottery.” Section 4804 hands that appointment to the Secretary of Finance with the governor’s approval, so the agency answers to the state’s revenue apparatus rather than to a gaming commission.

That lineage explains how a lottery office ended up holding casino authority. Delaware never built a Nevada-style control board. When the General Assembly moved to prop up horse racing in July 1994, it authorized slot machines at the tracks and defined them as video lottery games, which put them under the lottery statute by construction rather than by design. Table games, the sports lottery and internet gaming were bolted onto the same chapter, and 29 Del. C. 4801 still frames the scheme around state income and racing support.

Two Agencies, One Market

Investigative work sits elsewhere. The 2010 table games law created a Division of Gaming Enforcement, codified at 29 Del. C. 8236 inside the Department of Safety and Homeland Security. Delaware splits the job: the Lottery operates and licenses, the Division investigates.

THE STATE IS THE HOUSE

A State-Run Market, Not a Licensed One

The Office operates the game; the agent merely supplies the website. Delaware online blackjack is a state game on a casino’s storefront.

The defining language sits in the definitions at 29 Del. C. 4803. Internet lottery means “all lottery games in which the player’s interaction with the game operated by the Office occurs over the Internet.” Internet table games are games where interaction with “the game operated by the Office” happens “over the Internet through a website or network of a video lottery agent.”

Authority comes from 29 Del. C. 4826, added in 2012, which lets the Director operate an internet lottery and directs him to write rules on game types, accounts, authentication, funds, wagering limits and exclusion. The detail lives in 10 DE Admin. Code 206, which states that internet lottery operations “are strictly regulated by the Delaware State Lottery Office through the powers delegated to the Director.”

Two conditions hard-coded into 4826

No game may run unless the software “can verify that the player engaged in such game is physically present in the State,” and every site must carry a link for compulsive gambling services. Neither is left to the operator’s discretion, because there is no operator in the ordinary sense.

Where the Money Goes

Money moves the same way. Section 4815(e) routes the first $3.75 million of internet proceeds each fiscal year to the State Lottery Fund, and the remainder follows the formulas already governing video lottery and table games. The agent is paid to host a state product, not taxed on a win it kept.

How New Jersey Does It Differently

New Jersey issues internet gaming permits to Atlantic City casino licensees. Each permit runs one year, costs at least $400,000 to issue and $250,000 to renew, and nine casino hotels hold one. A permit holder may launch several distinct brands, each with its own platform, game suppliers, bonus budget and house rules, so a New Jersey player picks between genuinely different products. Why no fourth Delaware brand can appear

Section 4803 limits agent status to a person holding “either a horse racing meet license … or a harness racing meet license,” and Delaware has exactly three racetracks, so the number of brands is fixed by the number of operating tracks. Section 4805 adds that these licenses are personal privileges that cannot be transferred or assigned, meaning an outsider cannot buy its way in.

From Video Lottery to the First Online Casino in the Country

Every layer of Delaware gaming was bolted onto the same lottery chapter, which is why the state ended up first online almost by accident.

July 1994: video lottery legislation passes

The General Assembly authorizes slot machines at the racetracks and defines them as video lottery games, placing them under the lottery statute.

Terminals open at Delaware Park and what was then Dover Downs, with 715 and 500 machines respectively.

The third track opens video lottery with 500 terminals, completing the set of three agents that still defines the market.

May 2009: House Bill 100 clears the General Assembly

Gov. Jack Markell signs it, and the leagues and the NCAA sue under the federal sports betting ban. The Third Circuit confines Delaware to the multi-game NFL parlay format it had briefly run in the 1970s.

Single-game betting would wait until June 5, 2018.

The same legislation creates the Division of Gaming Enforcement, splitting investigation away from the Lottery.

House Bill 333 of the 146th General Assembly, styled the Delaware Gaming Competitiveness Act of 2012 and sponsored by Rep. Viola, passes the Senate on June 27 and is signed the next day. It lets the Lottery run traditional games online, allows the agents to carry internet versions of video lottery and table games, restructures agent fees and matches internet age rules to their offline equivalents.

November 2013: casino games go online

The Lottery’s published timeline marks Sept. 30, 2013 for the first state-authorized online gaming system and Nov. 7, 2013 for casino-style games. Other accounts give a different day, so November 2013 is the date worth carrying.

A common misdating worth correcting

The modern sports lottery effort began in 2009, not 2011. House Bill 100 cleared the General Assembly in May 2009 and the first parlay wagers were taken that September.

Nevada had gone online earlier in 2013 with poker only, which left Delaware the first state anywhere to put slots, table games and poker on the internet under state authority. What an agent actually controls

The agent relationship is narrower than it looks: an agent brands the site, markets it and earns a commission from the split above, but does not pick the games, choose the platform or hold the operating authority.

ONE PLATFORM

The Platform Behind All Three Sites

Three agents, three brands, and a single contracted technology stack underneath every one of them.

From 2013, Delaware’s internet product ran on 888 Holdings technology under a prime contract with Scientific Games. It lapsed in 2023 without a standalone mobile casino app ever reaching the market, leaving Delaware behind on phones. Rush Street Interactive won the replacement work, reported as a five-year deal extendable in one-year increments, and the Lottery’s iGaming page now advertises “NEW platforms powered by BetRivers” for all three casinos.

Structurally, all three agents sit on one platform, so software, accounts and catalog are common to every Delaware site.

One date this page will not assert

Dating the platform switch is harder than it should be. The Lottery’s timeline records a combined sports and iGaming app on Dec. 27, 2023, and trade coverage places the wider rollout in early 2024, but the agency publishes no official date for the casino migration.

The Split Inside Section 4810

Two legal ages in one section

It is unlawful for anyone under 18 to purchase a lottery ticket or participate in an internet ticket game. Subsection (a)(2) then provides that “It is unlawful for an individual who is under 21 years old to wager on the video lottery, sports lottery, table games, internet table games, or internet video lottery.” An 18-year-old may buy a draw ticket through the Lottery’s site but may not sit at an internet blackjack table, and both rules issue from the same section. What Regulation 206 Adds

Location before any real-money hand

The system must identify a player’s geographic location before any real-money game and block access when that location cannot be established, permitting play only where there is reasonable assurance the player is in Delaware or a compact jurisdiction.

Equipment approved down to the source code

Equipment needs the Director’s approval, with providers submitting schematics, network diagrams, manuals and both source and object code, and the Director may impose a trial period of up to 60 days first.

Blackjack at Delaware’s Online Casinos

Blackjack falls into internet table games, the smaller of Delaware’s two main online categories, and a bigger share of the state’s win than most licensed markets see.

Table games took a little over a quarter of the state’s online win. Because the Office operates the games, the experience is uniform: one table game library reached through three storefronts, and a player who dislikes the blackjack rules has no second Delaware room to try.

The Lottery reports revenue by category, not by title, so confirm inside the client what is running.   • The dealer’s soft 17 rule.
  • The deck count.
  • Doubling after splits.
  • Surrender.
  • Side bets, which carry a far worse edge than the main game.

Two conditions that never move

You must be 21 or older under 4810(a)(2), and you must be physically inside Delaware when the wager is placed. Residency is irrelevant; presence is everything.

THE POKER COMPACT

Delaware, Nevada and the Multi-State Poker Agreement

Delaware signed the first interstate online gaming compact in American history, and it has never covered blackjack.

On Feb. 25, 2014, Gov. Markell and Nevada Gov. Brian Sandoval signed the Multi-State Internet Gaming Agreement. Implementation lagged; the two states did not begin pooling poker players until March 2015. New Jersey joined later, and the compact now counts six signatories, Pennsylvania the most recent in April 2025.

Why the compact stops at poker

It covers poker and nothing else, for reasons of arithmetic rather than politics. Pooling solves a liquidity problem unique to games where players face each other, and a state of a million residents cannot fill enough tables at enough stakes alone. Delaware’s $764,608 of internet poker revenue in fiscal 2026 shows how thin that pool remains even with partners. Blackjack has no such problem, because the house banks every hand and the table exists whether one player or 1,000 are seated. Michigan’s iGaming statute says as much, authorizing multijurisdictional agreements “for poker” by name.

That is roughly one twenty-fifth of what Pennsylvania’s online casinos won in 2025. Population explains much of it: Delaware has about a million residents against Pennsylvania’s 13 million. The rest is structural: three brands on one platform generate none of the marketing pressure that drives sign-ups elsewhere. Enrollment happens in person at the Lottery office on weekdays, and forms cannot be requested by phone and mailed. An appointment is recommended on 302-744-1669.

Three terms, one of them final

You choose one year, five years or a lifetime, and lifetime cannot be undone: “If you sign up for lifetime, you cannot be removed from the list.” Shorter terms run in full before reinstatement can be requested, again in person.

One visit closes every door

The exclusion covers all three agents, their websites and the Lottery’s sports and iGaming app, so one visit closes every regulated door in the state.

Breaching it is a crime

A self-excluded person who knowingly enters a gaming area commits a Class A misdemeanor, and an excluded player cannot collect winnings or recover losses.

How to Verify That a Delaware Site Is Legitimate

Verification here is easier than anywhere else, because the market is closed.

Three authorized brands exist, corresponding exactly to Delaware Park, Bally’s Dover and Harrington, and the Lottery lists them on its iGaming page. A site taking Delaware wagers that is not one of those three is not operating under the Delaware Lottery, whatever seal it displays.
