Are Online Blackjack Sites Legal in Florida?
No. Florida has never authorized real money internet casino gaming, and there is no gray area on the licensing question.
Florida does not have a single licensed online blackjack site. Not one. No site offering real money blackjack to Florida residents holds a Florida license. The Florida Gaming Control Commission regulates pari-mutuel wagering, cardrooms, slot machine facilities and the Seminole compact. It does not license online casinos, because Florida law does not authorize them. The only state-sanctioned betting app in Florida is Hard Rock Bet, which is limited to sports wagering under the Seminole Tribe’s compact. Hard Rock Bet says so on its own platform, telling users that online casino games are not legal in Florida and directing them to visit a land-based casino instead.
That leaves Florida players in the same position as residents of roughly 40 other states. The blackjack apps and websites you see advertised to Florida are offshore operations, licensed in places like Curacao, Anjouan and Panama, operating outside the reach of any U.S. regulator. They take Florida players. They are not legal, licensed or supervised in Florida, and no Florida agency can help you if something goes wrong.
Florida at a glance
Two things make Florida unusually hard to change. The Seminole Tribe holds exclusive rights to house-banked card games, blackjack included. And Article X, Section 30 of the Florida Constitution, passed by voters in 2018, strips the Legislature of the power to authorize casino gambling on its own. Most states need a bill. Why the Blackjack Sites You See Advertised Are Not Regulated in the U.S.
Every real money blackjack site accepting Florida players is based outside the United States. These operators hold licenses from offshore jurisdictions, most commonly Curacao, the Anjouan Gaming Board in the Union of Comoros, or Panama. Those licenses are real in the sense that they exist, but they carry nothing close to the oversight of a Nevada, New Jersey or Michigan gaming license. There is no mandated independent game testing regime with U.S. enforcement behind it, no state-held player protection fund, no regulator you can file a complaint with and expect action from, and no legal mechanism to compel an operator to pay you.

The one offshore brand that has never blocked Florida
1. Bovada
Bovada is the most recognized offshore brand in Florida and one of the oldest still serving the U.S. market, dating to 2011. For blackjack players it offers both a random number generator table library and a live dealer section with real dealers streamed in real time. Bovada blocks players in roughly 19 to 20 states and the District of Columbia, mostly states with regulated markets, and Florida has never been on that block list.
Deposits work by card and cryptocurrency, with crypto withdrawals typically the fastest route. The main knock on Bovada for a serious blackjack player is that the casino welcome bonus is built around slots, and blackjack contributes little or nothing toward clearing it.
2. Ignition Casino

The name tells you the priority, but Slots.lv does carry a functional blackjack section with multiple variants and live tables. It is part of the same brand family as Bovada, Ignition and Cafe Casino, so the banking, support and payout behavior are broadly similar.

They accept Florida players anyway, because they operate from outside U.S. jurisdiction and Florida has no practical enforcement mechanism reaching a company incorporated in Curacao with servers in Costa Rica. Availability is not legality. A site being reachable from your phone in Orlando tells you nothing about its legal status.
What Florida Law Says About the Player
Section 849.08 is broadly worded
Florida’s general gambling statute, Section 849.08, makes it a second-degree misdemeanor to play or engage in any game at cards or other game of chance, at any place, by any device, for money or anything of value. That is broad statutory language, and “by any device whatever” is language courts have not needed to test against a smartphone. A second-degree misdemeanor in Florida carries up to 60 days in jail and a $500 fine.
In practice, Florida does not prosecute individual online casino players. Enforcement resources have gone toward illegal gambling arcades and slot machine trafficking, not toward people playing blackjack on their couch. But you should understand the distinction between “not prosecuted” and “legal.” The first is a matter of enforcement priority and can change. The second is a matter of law, and Florida has never made online blackjack legal.
How Close Florida Came to Criminalizing Player Activity in 2026
This is the part most Florida guides skip. Senate Bill 1580, filed in the 2026 session, would have criminalized conduct including to play, engage in, operate, conduct or promote internet gambling or internet sports wagering. That language targets players, not just operators. Only two states currently attach any penalty to the act of playing at an unlawful gambling site: Washington, where it is a Class C felony, and Maryland, where it is a civil violation. SB 1580 would have made Florida the third.
The Senate passes it unanimously
SB 1580 cleared the Florida Senate without a dissenting vote in early March 2026.
The House amends and passes its own version
The House changed the bill and passed it March 11, which meant the Senate had to vote again to concur.
The clock runs out
With the session ending March 13, the Senate never took up the amended version and the bill died. Florida players avoided that outcome by a margin of two days and a procedural vote.
It is coming back
Lawmakers and the Florida Gaming Control Commission have both signaled they intend to reintroduce enforcement legislation, so treat this as unfinished business rather than a settled question.
Payment and Banking Risk
UIGEA, signed in 2006, did not make online gambling legal or illegal in any state. What it did was prohibit gambling businesses from knowingly accepting payments connected to unlawful internet gambling and put the compliance obligation on banks and payment processors. The practical result for a Florida player is declined card deposits, blocked transfers and processors that abruptly stop working. Florida’s attorney general has now gone a step further and named payment companies as defendants alongside gambling operators, a development covered in the sweepstakes section below.
The federal statutes behind the friction
Neither federal law bans your play, but both shape how money moves to and from an offshore account.
Why Online Blackjack Is Not Legal in Florida
Any one of these alone would be significant. Together they explain why Florida is likely to be among the last states to authorize internet casino gaming, if it ever does.
The Seminole Tribe’s Exclusivity Over Banked Card Games
Blackjack is a house-banked card game, and in Florida house-banked card games belong to the Seminole Tribe. That exclusivity dates to the 2010 compact signed by then-Gov. Charlie Crist and was carried forward and expanded in the 30-year compact signed in 2021. The tribe pays for that exclusivity: at least $2.5 billion to the state over the first five years of the current compact, with revenue sharing running through 2051 and state forecasters projecting billions more over the life of the agreement.
Any online blackjack framework in Florida would put licensed competitors directly against the product the tribe is paying the state to protect. The tribe would have grounds to challenge it and, depending on the structure, grounds to reduce or halt its payments to the state. That is a fiscal problem for Tallahassee, not just a legal one.
Amendment 3 and the 60 Percent Voter Requirement
In November 2018, Florida voters approved Amendment 3 with about 71 percent support, codified as Article X, Section 30 of the Florida Constitution. It gives voters the exclusive right to decide whether to authorize casino gambling in Florida and makes the citizens’ initiative process the only method of doing so. The Legislature cannot authorize casino gambling by statute, and it cannot even place the question on the ballot itself.
The amendment’s definition of casino gambling is not vague on this point. It covers games within the federal definition of Class III gaming and states that this includes any house banking game, naming card games such as baccarat, chemin de fer, blackjack (21) and pai gow. Blackjack is written into the Florida Constitution by name as something voters, and only voters, can authorize.
A citizens’ initiative in Florida requires signatures equal to 8 percent of the votes cast in the last presidential election, gathered across a minimum number of congressional districts, followed by Florida Supreme Court review of the ballot language, followed by 60 percent approval at the polls. Amendment 3 was itself funded in large part by the Seminole Tribe and Disney, which spent tens of millions to pass it. The mechanism was designed to be hard to use, and it works.

The Legislature Is Moving to Restrict, Not to Regulate
Every 2026 bill was an enforcement bill
There is no meaningful pro-legalization caucus in Tallahassee on this issue. Not one 2026 measure proposed a licensing framework, a tax rate or a regulatory structure for online casino gaming. The policy conversation in Florida is about how to punish unlicensed operators, not how to license them.

The Florida Gaming Control Commission
The FGCC is a five-member body created to hold the state’s regulatory and executive authority over gambling, including pari-mutuel wagering, cardrooms, slot machine facilities and oversight of the Seminole compact. Everything except the lottery. Its Division of Pari-mutuel Wagering handles licensing and compact oversight. Its Division of Law Enforcement pursues illegal gambling operations.
The commission’s enforcement output has escalated sharply, with the 2025 seizure totals more than double the 2024 figures. That activity has focused on physical illegal arcades rather than online platforms, but it establishes the commission’s direction of travel. Its site is at flgaming.gov.
The Florida Deceptive and Unfair Trade Practices Act
FDUTPA is the attorney general’s preferred tool
It allows civil penalties, restitution and disgorgement without requiring a criminal conviction. Penalties can reach $10,000 per willful violation, rising to $15,000 where the violation involves a person with a disability or someone over 60. Combined with Chapter 849’s gambling-loss recovery provisions, it gives the state a civil path against operators that criminal law cannot easily reach.
Federal Law: The Wire Act and UIGEA
The Wire Act of 1961 prohibits using wire communications to transmit interstate or foreign sports bets. Its application to casino games has been litigated for years and the current consensus reading limits it to sports wagering. UIGEA, as covered above, regulates payments rather than play. Neither federal statute makes it a federal crime for an individual to play blackjack online, and neither one legalizes it either. Federal law is not the reason online blackjack is unavailable in Florida. State law is.

1979 to 1988: The foundation
The Seminole Tribe opened a high-stakes bingo hall in Hollywood in 1979, the first of its kind in the country. Florida sued to shut it down and lost. The resulting federal appellate decision, Seminole Tribe of Florida v. Butterworth, helped establish that a state could not enforce its regulatory gambling limits on tribal land, and became part of the legal foundation for the Indian Gaming Regulatory Act of 1988.
2004: Slots come to South Florida
Voters approve a constitutional amendment allowing slot machines at existing pari-mutuel facilities in Broward and Miami-Dade counties, converting racetracks and jai alai frontons into slot parlors and creating a competing gambling industry alongside the tribe.
2010: The first compact and blackjack exclusivity
Gov. Charlie Crist signs the first ratified Seminole compact. It grants the tribe exclusive rights to banked card games, including blackjack, in exchange for revenue-sharing payments to the state. This is the moment blackjack becomes a tribal asset in Florida.
2013: The internet cafe crackdown
Following the Allied Veterans of the World scandal, which reached into state government and forced the lieutenant governor’s resignation, the Legislature bans simulated gambling devices and shuts down hundreds of internet cafes and adult arcades statewide.
Nov. 6, 2018: Amendment 3 passes
Voters approve Amendment 3 with roughly 71 percent support, well above the 60 percent threshold. Backers spend more than $40 million on the campaign, with the Seminole Tribe and Disney as the principal funders. The Legislature loses the power to authorize casino gambling.
April and May 2021: The 30-year compact
Gov. Ron DeSantis signs a new 30-year compact with the Seminole Tribe in April and the Legislature ratifies it in a May special session. It authorizes statewide mobile sports betting through a hub-and-spoke model, adds craps and roulette at Seminole properties and guarantees the state at least $2.5 billion over five years. A provision that would have let the tribe negotiate over online casino gaming is stripped out by House Republicans to ease passage. Online blackjack was on the table in 2021 and was removed on purpose.
August to December 2021: Launch, then shutdown
The U.S. Department of the Interior allows the compact to take effect in August. The Hard Rock Sportsbook app launches in early November. On Nov. 22, U.S. District Judge Dabney Friedrich vacates the compact’s online sports betting provisions, finding the hub-and-spoke structure violated IGRA. The app goes dark in December.
June 2023: The D.C. Circuit reverses
A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit reverses the district court and upholds the compact, reasoning in part that the Interior Department’s approval by inaction was valid. The path to relaunch reopens.
November and December 2023: Hard Rock Bet returns
The app relaunches to existing users in November and opens statewide in December, with Dec. 5, 2023, marking full statewide availability. Revenue sharing resumes. From December 2023 through May 2024, tribal payments to Florida total $357 million.
June 17, 2024: The Supreme Court declines
The U.S. Supreme Court denies certiorari in West Flagler Associates v. Haaland, leaving the D.C. Circuit ruling in place. Justice Brett Kavanaugh would have granted the petition. An October 2024 settlement between the tribe and West Flagler closes the remaining litigation. Seminole exclusivity is locked in through 2051.
2025: Enforcement escalates, legislation stalls
The FGCC seizes $14.47 million and 6,725 illegal slot machines, more than doubling its 2024 numbers. Sweepstakes legislation fails for the first of two consecutive years.
2026 session: Every gambling bill dies
Five measures are filed. HB 189, running more than 100 pages, would have prohibited internet gambling and internet sports wagering outside the Seminole compact, criminalized advertising for unauthorized gambling and expanded FGCC jurisdiction over online enforcement. It cleared two subcommittees and a full committee, then stalled on the House floor, reportedly over provisions affecting amusement slot machines at fraternal organizations such as VFW posts. SB 1580 passed the Senate unanimously, was amended and passed by the House on March 11, and died when the Senate did not take up the amended version. SB 1164, HB 591 and SB 204 never advanced past their initial committees. The session adjourned March 13, 2026, with no gambling law enacted.
Aug. 19, 2026: The attorney general sues
Attorney General James Uthmeier files two lawsuits in Hillsborough County Circuit Court against Stake and VGW, the operator of Chumba Casino, LuckyLand and Global Poker, along with payment processors including Worldpay, Trustly, Praxis and Breeze Labs.
March 2, 2027: Next session convenes
The Florida Legislature’s 2027 regular session begins March 2, with interim committee work starting in late 2026. Enforcement legislation is expected to return.
Tribal Gaming and Blackjack in Florida
The Seminole Tribe is the only operator permitted to offer live blackjack anywhere in the state.
Seminole Casinos and Live Blackjack Tables
The Seminole Tribe operates seven gaming properties in Florida. Under the compact, five Seminole properties may offer banked table games including blackjack, baccarat, mini-baccarat, craps, roulette, let it ride, three card poker and pai gow poker. The flagship properties are Seminole Hard Rock Hotel and Casino Tampa and Seminole Hard Rock Hotel and Casino Hollywood, with additional properties at Coconut Creek, Immokalee, Brighton, Big Cypress and Seminole Classic in Hollywood. The minimum age for table games is 21.
The tribe is the most economically consequential tribal nation in the country. It owns Hard Rock International outright and generates an estimated $3 billion or more in annual Florida gaming revenue across land-based operations and Hard Rock Bet.
How the Hub-and-Spoke Model Works
The legal architecture behind Hard Rock Bet is worth understanding, because it is the closest Florida has come to legal online gambling of any kind. When a bettor anywhere in Florida places a wager through the app, the wager is routed to servers physically located on Seminole tribal land and is deemed to occur there. That fiction is what allows statewide mobile betting under IGRA, which limits tribal gaming to Indian lands. Federal courts upheld it. Hard Rock Bet’s Q1 2026 handle was reported at $1.2 billion, with mobile accounting for about 92 percent of wagers.
The deeming language sits in statute, not only in the compact
Florida deems a wager placed anywhere in the state to occur where the server sits on tribal land, and that language lives in Florida statute 285.710 rather than only in the compact text. That is what makes the Florida model weak precedent for other states trying to copy it.
People sometimes ask why the same structure could not deliver online blackjack. Legally it could, in theory. The Aug. 19, 2026, Lawsuits
Attorney General James Uthmeier filed two complaints in Hillsborough County Circuit Court on Aug. 19, 2026, alleging that Stake.us and VGW’s Chumba Casino, LuckyLand Slots, LuckyLand Casino and Global Poker are illegal online gambling operations under Chapter 849 and FDUTPA. In announcing them, Uthmeier said that if something looks like a casino, takes real money like a casino and pays out like a casino, it is a casino and it is illegal under Florida law. Several features make this filing more serious than the subpoenas and cease-and-desist letters other states have used.

The category was contracting in Florida before the lawsuits landed and has kept contracting since. VGW announced on its own timetable that LuckyLand Slots would end North American operations Sept. 14, 2026. Path two: a compact amendment
The more plausible route, and it is still not likely. The state and the Seminole Tribe could negotiate an amended compact authorizing online casino gaming operated by the tribe through the same hub-and-spoke structure that supports Hard Rock Bet, with federal approval from the Interior Department. This would not create a competitive market. It would create a tribal monopoly on online blackjack, the way Hard Rock Bet is a monopoly on sports betting.
Path three: federal change
Effectively off the table. There is no serious federal effort to legalize online casino gaming nationally, and gambling regulation has been left to the states since the Supreme Court struck down PASPA in 2018.
Even the compact route faces an Amendment 3 challenge. The constitution carves out tribal compacts negotiated under IGRA, which is how the 2021 compact survived. Whether that carve-out extends to a new category of statewide online gaming is a question that would be litigated, probably for years, by the same pari-mutuel interests that funded Amendment 3 and fought the sports betting compact to the Supreme Court.
