West Virginia Lottery: The Regulator Behind a Five-License Casino Market

Why two different numbers can both be right

A list of West Virginia casino brands can run longer than five without contradicting the statute, because the statute limits licensees while the list counts skins. National brands appear here without holding a state operator license at all: they ride a property’s license as an approved management services provider, inside the three-skin ceiling and the display requirement. That ceiling makes the state the odd one out among the jurisdictions offering legal blackjack on a phone, and it explains most of what separates its lobbies from Michigan’s or Pennsylvania’s. It also explains why the same market can be described accurately in two ways that sound contradictory until you know which unit is being counted.

THE AGENCY

What the West Virginia Lottery Is

The state never built a separate casino regulator. It kept handing new duties to the lottery agency it already had.

The agency answers to the West Virginia Lottery Commission, a board of gubernatorial appointees, with daily operations run by a director. New Jersey and Michigan built dedicated casino regulators; West Virginia layered each new form of gambling onto the same body.

One commission therefore signs off on terminal software, table game rules, sportsbooks and online platforms alike, and 179 CSR 10-3.1 makes the stacking explicit: an internet gaming operator must also comply with the video lottery and table games acts. An online blackjack table inherits rules written for a felt table in Charles Town.

HOW IT PASSED

The Interactive Wagering Act and the Launch Nobody Covered

Gov. Jim Justice declining to sign is less mysterious than it looks: his family’s business interests include The Greenbrier, one of the five properties eligible for a license under the bill on his desk.

Counting Nevada, whose interactive license covers poker only, the July 2020 launch made West Virginia the fifth state with legal online gambling of any kind and the fourth with house-banked internet casino games. Almost nobody covered it. The launch landed in a summer when sports schedules were shredded and gambling coverage was consumed by whether leagues would play at all. With fewer than 1.8 million residents, the state was never going to produce the numbers analysts were modeling for Michigan, which had passed its own law in December 2019 and held the industry’s attention. And one brand opened on day one, with rivals trickling in over the following year.

LICENSING

Licensing: Five Years, $250,000 and a Ceiling of Five

To apply at all, an entity must already hold a racetrack video lottery license or a valid license to operate a gaming facility.

The terms sit in W. Va. Code 29-22E-6. An interactive wagering operator license runs five years and may be renewed for further five-year periods, and the entry requirement is an existing license under 29-22A or a valid license to operate a gaming facility. The technology and brand companies that build the consumer product are licensed separately, and those renew annually rather than every five years.

What a Hard Ceiling Does to a Lobby

Set West Virginia against the pace-setters. Michigan has 15 authorized internet gaming operators, all live. Pennsylvania had 11 casinos reporting internet gaming revenue in July 2026, most running several skins each. West Virginia’s entire market is legally incapable of exceeding what Michigan already has, and three consequences follow.

Bonuses are less aggressive

Welcome offers are an acquisition weapon, and their size tracks how hard operators must fight for a finite audience. Where a newcomer cannot buy a license and enter, incumbents face less pressure to bid.

Game libraries are thinner

Studios certify new titles where the operators and players are, so a supplier weighing its next blackjack variant looks at Pennsylvania and Michigan first. West Virginia gets the same catalog later, sometimes not in full.

There is less redundancy

Fewer licensees means fewer places to go when an operator’s withdrawal times slip or its terms turn hostile. Where a Pennsylvania player has a dozen alternatives, this list is short.

The bargain is not irrational

Tying every license to an existing property means the commission already knows the ownership, finances and compliance record of everyone it supervises.

TAX AND REVENUE

The Tax Rate and Where the Money Lands

Fifteen percent is low regionally and, unusually, flat. The same rate applies to a blackjack shoe and a slot spin.

Section 29-22E-16 imposes a privilege tax of 15 percent of a licensee’s adjusted gross interactive wagering receipts, in weekly installments due by the Wednesday after the week the receipts came in.

Charging one rate on every product removes the incentive some operators have elsewhere to steer players toward the cheaper game.

Distribution runs through 29-22E-17, which creates the West Virginia Lottery Interactive Wagering Fund. The commission may keep up to 15 percent of gross deposits for administration, remitting any monthly surplus above $250,000 to the State Treasurer as net profit. One-quarter of 1 percent of net profit goes annually to four Racing Commission funds supporting pension plans for racing association employees. The rest flows into the State Lottery Fund created by 29-22-18, which underwrites education, senior services and tourism.

FIVE PROPERTIES, FIVE LICENSES

The Land-Based Tie and the Skin Arrangement

Four racetracks plus one historic resort hotel. The cap is a headcount of existing casino properties, not an arbitrary number.

The findings in 29-22E-2 state the design plainly. Interactive wagering happens at racetracks licensed under 29-22A “and at a historic resort hotel,” and the Legislature found that “the operation of the four racetracks and the historic resort hotel in this state play a critical role in the economy of this state.” Those properties, per the West Virginia Racing Commission, are these five.

The license belongs to the property. The brand you log into usually does not. A licensed operator contracts with management services providers, each licensed under 29-22E-7, and those providers supply the platform, games, payments and support under their own names. That is how national brands appear here without holding a state operator license: they ride a property’s license as an approved provider, inside the three-skin ceiling and the display requirement. THE GAME ITSELF

Blackjack at West Virginia Licensed Sites

The statute never names the game. It does not have to, and each title still needs approval.

Section 29-22E-3 defines an interactive game to cover “casino themed slot simulations, table games, and other games approved by the commission,” so blackjack qualifies. Rule 10-8.1.8 requires the system to be built so the commission can approve every software installation, and 10-8.2 requires hash validation so approved programs cannot be quietly altered later.

The result is a smaller version of the standard regulated shelf: several random number generator blackjack titles, usually a classic multi-hand game, a single-deck or Spanish-style variant, and at least one carrying side bets. Minimums often start around a dollar, well below any physical table in the state. Rules differ title by title, so read the paytable first: whether naturals pay 3-2 or 6-5 moves the math more than anything else on screen, as our breakdown of blackjack payout differences explains.

Live Dealer, Dealt From Another State

Live blackjack is available, and the rule treats it as “table game simulcasting” under 179 CSR 10-9. An operator needs approval to simulcast and must run a control server that meets several duties at once.

  • Provide real-time visual access to the table.
  • Prevent anyone from seeing an outcome before a wager is finalized.
  • Record dealer-verified results before posting them.
  • Retain the ability to void a result.
  • Operate under closed circuit surveillance built to commission specification.

Rule 10-9.4 entitles the player to see the table limits, the number of decks, dealer actions and the payout odds as play happens.

The geography is the unusual part

Evolution announced on June 28, 2022, that its live casino product had gone live in West Virginia, with opening titles including Blackjack and Infinite Blackjack, streamed from its Pennsylvania studio. Other states have generally insisted the dealer stand inside their own borders. West Virginia regulates the wagering system, the control server and the surveillance rather than the postcode of the felt, and 179 CSR 10-6.2 confirms that intermediate data routing does not determine where a lawful intrastate wager was placed, tracking UIGEA at 31 U.S.C. 5361 through 5367.

Before you sit down at a West Virginia table

The rules on screen matter more than the brand above them. These guides cover what to check first.

ELIGIBILITY

Who May Play: 21 and Inside the State Line

Section 29-22E-15 sets two conditions, repeated in rule 10-3. There is no residency test anywhere.

A person placing a wager must be at least 21, and the wager must go through that patron’s account either inside a licensed gaming facility or from someone physically located within West Virginia. Presence, not residence, is what the statute asks about.

The wager is allowed

  • You are 21 or older.
  • You are physically located within West Virginia, or inside a licensed gaming facility.
  • An Ohio resident standing in Wheeling may play.
  • The wager goes through your own patron account.

The wager is blocked

  • You are under 21.
  • You are outside the state line, whatever your address says.
  • A West Virginian on vacation in Florida may not play.
  • Your account was flagged as self-excluded or otherwise prohibited at signup.

Enforcement lives in 179 CSR 10-13. Operators must use a geolocation system to detect where a player actually is and to block access from outside the state, and 10-13.2 requires that system to monitor location dynamically throughout the session rather than checking once at login. Age, by contrast, is checked once at signup: 10-7.2.5 requires an operator to verify before opening an account that the patron is 21, not self-excluded and not otherwise prohibited.

DISPUTES

Complaints: 10 Days, Then the Director

You must start with the operator, but the operator is obliged to tell you how to go over its head.

Complain to the operator

Rule 10-5.6.14 requires the terms and conditions to publish a method for complaining to the operator, and a method for taking an unresolved complaint to the director.

Ten calendar days

Under 10-5.5 an operator must investigate each patron complaint and respond within 10 calendar days.

Escalation to the Lottery director

If it is not resolved to the patron’s satisfaction, or if it concerns accounts, game outcomes or illegal activity, the complaint and the operator’s response with supporting documentation go to the director.

Hearing

Hearings then run under the state Administrative Procedures Act.

Two protections sit behind that process

Rule 10-3.3 requires a cash reserve covering outstanding player balances, verified by Lottery staff quarterly. Rule 10-6.23 forbids an operator from taking funds out of your account except for a confirmed chargeback, proven cheating or collusion, a court order or commission approval, with monthly reporting of every removal. That is far narrower than the discretion an unlicensed site reserves for itself, which is the practical core of the offshore versus licensed comparison and of what you can demand as a player in a regulated state.

RESPONSIBLE GAMING

Self-Exclusion and Responsible Gaming Duties

The limit tools here are specified by rule rather than left to the operator, and self-exclusion runs on two separate tracks.

Commission duties under 29-22E-4 include requiring the statement “If you or someone you know has a gambling problem and wants help, call 1-800 GAMBLER,” which 179 CSR 10-5.15.1 carries onto every operator’s responsible gaming page. That number still connects and remains a state advertising requirement, but it is no longer the national line. Confidential counselors answer 1-800-697-3738, the national line since Jan. 29, 2026, every hour of every day at no charge.

Rule 10-5.15 also requires a responsible gaming logo approved by the director, linking to a page reachable mid-session that carries the helpline message, a direct link to the Problem Gamblers Network of West Virginia, and the rules for self-imposed limits. Rule 10-6.22 sets out what those limits must include.

Decreases take effect no later than your next login, while increases apply only once the previous limit’s period expires, which is what stops a bad night being solved by raising your own ceiling.

Two self-exclusion lists, and confusing them is a real risk

Rule 10-5.13.3 treats operator-level self-exclusion and the Lottery’s statewide program as separate things. The Lottery’s statewide self-exclusion program covers the four racetrack casinos and The Greenbrier’s casino, and the agency warns that an iPLAY self-exclusion, tied to its own online lottery play, does not exclude you from sports betting or iGaming. If your aim is to shut off online blackjack, confirm in writing which list you are joining.

SHARED LIQUIDITY

MSIGA Membership, and Why It Changes Nothing for Blackjack

West Virginia signed the multi-state agreement in 2023. For a house-banked game, the effect is academic.

West Virginia joined the Multi-State Internet Gaming Agreement in November 2023, the fifth signatory alongside Nevada, Delaware, New Jersey and Michigan. Pennsylvania followed in April 2025. The authority is 29-22E-14, which lets the commission enter agreements with other governments so people in a signatory jurisdiction may take part in wagering conducted by West Virginia operators, provided the agreement covers revenue sharing, licensing, technical standards and patron disputes. Rule 10-3.4 carves those wagers out of the in-state presence requirement.

West Virginia’s statute is not written for poker specifically. It speaks of interactive wagering generally, broader than Michigan’s authorizing language and broader than what MSIGA actually does. For blackjack players the breadth is academic, for a reason that has nothing to do with law. Shared liquidity solves a problem that exists only in player-versus-player games: poker needs opponents, and a small state cannot fill enough tables at enough stakes. Blackjack is banked by the house, and the dealer is always available. Adding Michigan and New Jersey players to a West Virginia blackjack table would shorten no queue and build no pot.

A marketing claim worth ignoring

Any site marketing shared liquidity as a blackjack benefit is selling you something.

Verifying a License Before You Deposit

Because the cap is five and each license is tied to a named physical property, the universe of legitimate licenses is tiny. That makes the negative test easy.

Rule 10-20.2 requires it on the webpage and the mobile splash screen, so a casino aimed at West Virginians that names no operator is not licensed here.

Check any claim about status against 179 CSR 10, the West Virginia Lottery Interactive Wagering Rule, whose current version took effect April 27, 2026.

Ask the agency rather than trusting a badge image on the site you are checking.

A site offering real money blackjack to a West Virginia player outside that structure carries none of the reserve requirements, complaint deadlines, limit tools or fund-removal restrictions described above.

One caveat on the live count

The five-license ceiling is statutory and stable, but we have not said how many licenses are active today, because no current, dated Lottery publication confirming a live count could be found. Treat any source offering a confident number without citing one with skepticism.
