2025: SB 827 Introduced and Sent to Study

Jan. 8, 2025: SB 827 is introduced to legalize online casinos in Virginia.

Jan. 21, 2025: The bill is put on hold so the Senate Subcommittee on Gaming can study the feasibility and impact of legalizing iGaming. The study runs through the year, with a joint subcommittee also examining whether Virginia should create a single gaming regulator, with authority to study through Nov. 30.

Nov. 7, 2025: The Pamunkey Indian Tribe and Boyd Gaming open the Interim Gaming Hall in Norfolk with 132 slot machines, meeting a mandatory license issuance deadline of Nov. 15, 2025.

2026: HB 161 and SB 118 Pass Separately, Then Die in Conference

This is the year that matters, and the detail is worth walking through.

Jan. 6, 2026: Delegate Marcus Simon, a Democrat from Falls Church, pre-files House Bill 161. It is introduced to the House on Jan. 14. Senate Bill 118, carried by Sen. Mamie Locke, is introduced the same period.

Both bills would have done substantially the same thing:

• Authorize each of Virginia’s five licensed land-based casinos to offer online casino gaming, including online blackjack, other table games, slots and live dealer games
• Allow each casino up to three online operator skins, for a maximum of 15 online casino brands statewide
• Charge each retail casino a $2 million platform fee and each online operator a $500,000 license fee
• Tax online gaming at 20 percent of adjusted gross gaming revenue
• Place regulation under the Virginia Lottery Board, with regulations to be finalized by Sept. 30, 2026
• Explicitly classify dual-currency sweepstakes casinos as illegal internet gaming
• Grant regulators and the attorney general authority to issue cease-and-desist orders, subpoenas and injunctions against unlicensed operators, including offshore sites

The bills differed on where the money goes. HB 161 directed 89 percent of tax revenue to the general fund until January 2037 and 95 percent after that, with 5 percent to a Problem Gambling Treatment and Support Fund and 6 percent to an Internet Gaming Hold Harmless Fund designed to cushion retail casinos. SB 118 directed 95 percent to a Modern Public Education Fund, 3 percent to a Gaming Regulatory Fund and 2 percent to problem gambling. HB 161 also included a clause requiring at least 25 percent of promotional revenue to be redeemable at the partnered land-based casino.

2026: SB 579, the Sweepstakes Ban That Became a Study

SB 579 was filed in January 2026 as a standalone bill to declare dual-currency sweepstakes operators providers of illegal gambling. The Senate Committee for Courts of Justice amended it rather than passing it, replacing the ban with a requirement that the Virginia Lottery Board convene a study group to review and analyze the sweepstakes casino industry and report recommendations back to lawmakers. The bill requires that stakeholders from the sweepstakes and social gaming industries be included in the group alongside officials and regulators. The motion to continue the bill to 2027 passed a committee vote 14-1.

Net result: sweepstakes casinos remain legal and available in Virginia, and the issue returns in 2027 with a study report in hand.

2026: Skill Games Bill SB 661 Vetoed

SB 661 would have legalized and regulated skill games. It cleared the Senate 24-15 in February 2026 and passed the General Assembly before adjournment. Its terms: up to 25,000 machines statewide, down from an estimated 90,000 currently operating illegally, a 25 percent tax on gaming device profits, a $5 maximum wager, a $5,000 cap on single-play winnings, a $250,000 annual distributor license fee, $1,000 annually for host businesses and $2,500 for truck stops. Tax revenue would have been split with 6 percent to the Alcoholic Beverage Control Authority for regulatory costs, 2 percent to problem gambling, 1 percent to the State Police Office of Gaming Enforcement and 1 percent to local law enforcement.

The day before, she vetoed HB 756, which would have required Fairfax County to hold a casino referendum for a Tysons Corner project. Lawmakers reconvened April 22, 2026, to consider her amendments and vetoes.

One gaming bill she did sign takes effect July 1, 2026: a 10 percent tax on online fantasy sports revenue for paid-entry contests meeting certain conditions.

Are Sweepstakes Casinos Still Legal in Virginia?

Yes. As of August 2026, sweepstakes casinos are legal and operating in Virginia. The Commonwealth has no statute specifically prohibiting the no-purchase-necessary dual-currency model, state regulators have taken no enforcement action against sweepstakes operators, and the attorney general has not issued cease-and-desist orders.

Virginia is now a comparative outlier. New York, New Jersey and California passed sweepstakes bans in 2025. Montana, Connecticut and Nevada have also acted. Maryland bills advanced through the House ahead of its March 23 crossover deadline. Virginia, Florida and Massachusetts all let their ban bills expire without passage.

SB 579: From Sweepstakes Ban to Industry Study

The near miss is worth understanding, because it tells you what 2027 looks like. SB 579 started as a ban. Proponents argued Virginia needed stronger enforcement as sweepstakes platforms grew nationally. The Senate Committee for Courts of Justice instead amended it into a study mandate, handing the Virginia Lottery Board responsibility for convening a group to review the legal, economic and policy implications of sweepstakes gaming, with sweepstakes and social gaming industry stakeholders required to be included alongside regulators to avoid one-sided findings. The committee then voted 14-1 to continue the bill to 2027.

That study will report to lawmakers before the 2027 session. Whether it recommends a ban, a licensing framework or continued tolerance will shape what happens next.

The Sweepstakes Ban Language Inside HB 161 and SB 118

The second and larger threat came bundled with iGaming legalization. Both HB 161 and SB 118 contained language classifying real-money sweepstakes using dual-currency systems as illegal internet gaming. HB 161 specified that the dual-currency structure does not exempt an operator from Virginia gaming law, and defined sweepstakes as a promotional, advertising or marketing event, contest or game, played online or in person, in which a prize or prize equivalent is awarded directly or indirectly.

Under that framework, sweepstakes operators would have faced civil penalties of up to $100,000 for a first offense and $250,000 for subsequent offenses, and the Virginia Lottery Board would have gained authority to issue cease-and-desist notices and pursue court action against non-compliant platforms.

It was unclear whether the sweepstakes ban would have been delayed by the reenactment clause along with the rest of the bill, or taken effect immediately. The question became moot when both bills died on March 14.
