Subsection (b) elevates professional gambling to a felony, where exposure reaches three years and $3,000. W.S. 6-7-101 draws the line by role: professional gambling means aiding or inducing another to gamble in order to profit from it, or participating while holding a structural edge over other participants. That targets operators and house bankers. Someone placing a bet falls under subsection (a).
Wyoming has built no enforcement program around individual internet players, and the July 2026 committee discussion showed why: lawmakers themselves questioned whether the commission has any workable tool to reach an operator incorporated overseas, let alone a customer in a living room in Gillette. That describes where enforcement attention goes rather than any grant of immunity, and none of it substitutes for counsel. Two further consequences follow: disputes end where the operator says they end, and no state-supervised exclusion list covers these sites.
Sweepstakes Blackjack and the Ban That Has Not Happened Yet

A meaningful share of operators geofenced Wyoming rather than test whether the agency would escalate. Others stayed. The result in the summer of 2026 is a thinner but functioning sweepstakes market with availability shifting operator by operator, so finding an app that accepts a Wyoming sign-up today is no assurance about next quarter.
2026 interim: the prohibition draft fails
The Legislature’s Select Committee on Gaming took up a draft writing online casino games and sweepstakes platforms directly into the definition of professional gambling, which would have made operating a sweepstakes casino for Wyoming customers a felony rather than a gray-area question. At the July 2026 meeting it failed to advance. Some members were not persuaded a new definition was needed. Others doubted the commission could enforce anything against companies abroad. Sept. 29, 2026 in Evanston: the narrower redraft
Members voted to request a narrower draft aimed at internet casino gambling for their next meeting. The honest status: legal in the sense that no statute names the model, available in the sense that some operators still take Wyoming sign-ups, unstable in the sense that a bill to end it is being redrafted right now.

What Wyoming’s Gambling Code Actually Says
A general prohibition, a heavier prohibition on gambling as a business, and a list of carve-outs that has grown one activity at a time.
The criminal gambling provisions sit in Title 6, Chapter 7 of the Wyoming Statutes, in the state’s own Title 6 compilation. The structure is old-fashioned and broad.
Under W.S. 6-7-101, you are gambling any time property goes at risk for gain that turns, “in whole or in part,” on a lot, on chance, on how a gambling device performs, or on how some event resolves. Those five quoted words carry enormous weight. They are why skill-based machines have been such a persistent fight here, and why a blackjack hand sits inside the definition without argument.
Carved out of the definition
Genuine tests of speed, strength, endurance or skill; legitimate business transactions; licensed charitable bingo and pull-tabs; social games among natural persons where nobody takes a rake; the Wyoming Lottery; fantasy sports; and antique devices kept in a residence.
Authorized separately under Title 11
Pari-mutuel wagering, historic horse racing terminals, skill-based amusement games and online sports wagering are authorized under Title 11, Chapter 25. That is the full extent of the Gaming Commission’s jurisdiction.
Internet casino gambling
It appears nowhere in either set. That is the whole legal story: blackjack for cash over the internet is swept up by the general prohibition and has never been granted an exemption.
Wyoming sets no universal age
Eighteen governs the lottery, charitable bingo and pull-tabs, pari-mutuel and historic horse racing wagering, and licensed online sports wagering, which puts Wyoming in the small minority of jurisdictions where an 18-year-old may legally back a game. Tribal properties set their own floors, with poker rooms and alcohol-service areas at 21.

2021: sports betting clears, casino games are left behind
House Bill 133 of the 2021 general session, carried by Rep. Tom Walters, authorized online sports wagering under Gaming Commission oversight. Its path was not smooth: the House voted it down, then reconsidered the next day and passed it, foreshadowing how narrow the appetite for expansion would remain. Gov. Mark Gordon signed it April 5, 2021 as House Enrolled Act No. 50, and the first apps went live Sept. 1, 2021. The law required a minimum of five licenses, taxed operators at 10 percent of gross revenue, routed the first $300,000 collected annually to the Wyoming Department of Health for county-level treatment, and made Wyoming the first state to expressly permit cryptocurrency funding of licensed wagering accounts.
HB 133 covered sports only, and that deliberate narrowness is part of why it survived. The result is the situation Wyoming has now: a state comfortable with a regulated gambling app on the condition that the app never deals a card. 2024: HB 120 falls short at the door
House Bill 0120 of the 2024 budget session, titled simply “Interactive gaming,” was the first serious attempt to license internet casino play. Rep. Robert Davis carried it, joined by Reps. Jon Conrad, Sandy Newsome and Tom Walters and by Sen. Mike Gierau, spanning both parties and both chambers.
It never got a policy hearing. On Feb. 15, 2024 the House took the introduction vote required in a budget session and the tally was 25 ayes, 36 noes, one excused. Two-thirds of the 62-member chamber is 42, so the bill finished 17 short. Compounding the problem, the Gaming Commission signaled it was not prepared to support the proposal, removing the one voice legislators normally defer to on a technical licensing question. The official record shows the failed introduction as its final action.
2025: HB 162 dies for want of a second
The 2025 general session produced the best-prepared gambling bill Wyoming has ever seen. Between sessions the commission and the legislature had hired Spectrum Gaming Group to study the future of gaming here, mandated through the Joint Appropriations Committee in the 2024 general appropriations act. The study landed in November 2024 and made a favorable case: a legal internet casino market projected to produce gross gaming revenue of roughly $93.4 million to $138.4 million during its opening year, climbing toward $199 million by year five, with as much as $40 million reaching the state.
House Bill 0162 followed. Davis was again primary sponsor, joined by Reps. Landon Brown, J.T. Larson and Tarver and by Sens. Barlow, Pappas and Schuler. It defined interactive gaming to include poker, blackjack and any other card, slot or gambling game typically offered in a casino, played through a computer, digital platform or mobile application. Licensees would have paid 16 percent of monthly gross gaming revenue, again with the first $300,000 going to the Department of Health. Projections estimated a $2.9 million increase for counties and $3.6 million for the School Foundation Program account in fiscal 2026. The bill also contemplated interactive gaming on tribal land through a compact. Assigned Jan. 13, 2025, it cleared introduction Jan. 20 and went to House committee 06, Travel, Recreation, Wildlife and Cultural Resources, further than any Wyoming online casino bill had ever traveled.
Then it stopped. At the Feb. 3, 2025 hearing, representatives of the Northern Arapaho and Eastern Shoshone testified against it, arguing that sports betting and historic horse racing had already cut into tribal gaming revenue and that internet casino games would erode the earnings funding tribal services. Problem gambling advocates also opposed. Industry witnesses testified in favor, including Sarah Filosa of the Sports Betting Alliance, who framed the bill as converting an untaxed market into a supervised one, and John Pappas of the iDevelopment and Economic Association, who argued the state needed statutory clarity to act against unlicensed operators.
When discussion ended, a motion to report the bill favorably was made and no member seconded it. Chairman Andrew Byron declared it postponed indefinitely. The record shows no report before the Committee of the Whole cutoff Feb. 7, 2025 and the bill dying in committee March 3, 2025 under House Rule 5-4, preserved in the bill history.
A motion dying without a second is a specific kind of defeat
Of the members present, not one would put their name on sending it to a floor debate. Advocates who call 2025 a near miss are overstating it. The near miss was 2024, when 25 members voted to introduce.
2025 interim: five failures produce a committee
HB 162 was not the only casualty. The Joint Appropriations Committee had forwarded five committee-sponsored gambling bills covering statutory cleanup, municipal authority over pari-mutuel permits and expanded simulcast wagering on live Wyoming races. None passed. The Senate separately voted down a measure bringing the Eastern Shoshone and Northern Arapaho into the state’s online sports wagering framework, notable given that tribal exclusion from mobile betting is among the grievances the tribes cited against HB 162. The legislature responded by creating a Select Committee on Gaming in spring 2025, giving gambling policy a dedicated interim home.
2026: a budget session with no casino bill at all
The 20-day 2026 budget session convened Feb. 9, 2026 and no interactive gaming bill was filed. Sponsors who had watched HB 120 lose 25 to 36 in the identical procedural setting two years earlier had no reason to spend capital on a repeat.
What moved in 2026 were restrictions, the clearest available signal about the chamber’s mood. Senate File 0046, limiting where skill-based machines may sit, passed the Senate 31-0 on Feb. 20, 2026 and the House 55-2 on March 3, 2026 before being signed as Senate Enrolled Act No. 39 with an emergency clause. A legislature that could not find 42 votes to introduce an online casino bill found 86 combined votes to restrict slot-style machines in convenience stores. The law behind the ledger
Wyoming’s state code is only half the picture. Federal statutes shape what any operator can offer a Wyoming resident.
Why Even-Numbered Years Are Where Gaming Bills Go to Die
One clause of the Wyoming Constitution explains more about state gambling policy than any argument ever made in a committee room.
Wyoming alternates a 40-day general session in odd-numbered years with a 20-day budget session in even-numbered years. Article 3, Section 6 of the Wyoming Constitution provides that during a budget session no bill other than the budget bill may be introduced unless placed on call by a two-thirds vote.
Do the arithmetic. A bill can hold a comfortable working majority of 35 or even 40 and still never reach a committee, never get a hearing, never receive an amendment.
The rule compounds on controversial subjects. Members who are neutral, or who simply want more information, have a cost-free way to vote no: the session is short, the budget is the priority, and a nonbudget bill can always return next year. A vote against introduction reads as institutional discipline rather than a policy stance. The practical consequence is a two-year cycle in which odd-numbered years are the only realistic windows, which is why the Sept. 29, 2026 Evanston meeting matters more here than the entire 2026 session did.
The Skill-Machine Fight Nobody Outside Wyoming Talks About
Ask a Wyoming legislator about gambling and you are likelier to get an answer about the machines in the gas station than about the internet.
The skill-based amusement game fight is the defining state gambling story of the decade and the biggest single reason online casino bills keep failing. The machines arrived through the door the statutory definition left open. Because W.S. 6-7-101 excludes bona fide contests of skill, manufacturers built terminals that look and sound like slot machines while requiring a player input that supposedly determines the outcome. They spread through convenience stores, truck stops, smoke shops and bars.
2020: authorize rather than ban
The legislature responded by authorizing and taxing the machines rather than banning them. House Bill 171 became House Enrolled Act No. 95 on March 17, 2020, with a June 30, 2021 sunset.
2021: the sunset is deleted
Lawmakers revisited it and blinked. Senate File 56 became Senate Enrolled Act No. 44 on April 5, 2021 and deleted the sunset entirely.
2022: placement restricted, installations grandfathered
Senate File 41 followed, signed Feb. 18, 2022 as Senate Enrolled Act No. 25, restricting placement while grandfathering existing installations. The commission’s skill-based amusement games page carries that history plus permitting rules. A qualifying establishment is a truck stop, a smoke shop, or a business licensed to sell alcoholic liquor. Reported limits keep individual play small: roughly $3 maximum per play, a payout ceiling near $3,000, and about four machines per location.
Nov. 18, 2025: the backlash arrives
The legislature’s Management Council advanced drafts from the Select Committee on Gaming: language giving prosecutors a cleaner path to charge house-banked operations while protecting private games among friends, a bill making money laundering a state felony, a measure barring new skill-game permits at package liquor stores, and a bill handing towns and counties authority over simulcasting approvals and terminal siting. Senate President Bo Biteman captured the mood in a line that has followed the debate since, describing how a longtime family pizza restaurant in Sheridan had turned into a casino, and calling it sad.
Why this matters for blackjack
Legislators watched an unregulated category grow into a statewide network of quasi-slot machines inside family businesses and concluded that gambling expands further than anyone authorizing it expects. When Davis brought them a bill to license internet casino games, that experience was in the room.
The Wind River Reservation and Its Four Casinos
Every brick-and-mortar casino in Wyoming is tribal, and all sit on or near the Wind River Reservation.
The reservation is shared by the Eastern Shoshone and the Northern Arapaho. Their legal footing comes from the 1988 Indian Gaming Regulatory Act, a federal statute that sets three tiers and conditions the top one, Class III, on a negotiated state compact.
