Someone introduces the joint resolution

Amendment L on the Nov. 3, 2026 ballot, referred as House Joint Resolution 5003 after 61-5 and 29-4 votes in early 2025, would require 60 percent approval for any future constitutional amendment. Amendment Q cleared 56 percent in 2014 and Amendment B cleared 58.5 percent in 2020. Both would have failed under a 60 percent threshold.
A framework, rules and compact amendments get built
Lawmakers would have to build a framework, the Commission would have to write rules, and tribes would need compact amendments in parallel. Objections to being written out of SJR 504 were a live factor in its defeat, a preview of how a casino measure would go.
A realistic read: a mobile sports wagering amendment is the likeliest next gambling question on a South Dakota ballot, and 2028 is the earliest plausible date given that the 2026 ballot is set. Internet blackjack sits several steps behind. No organized campaign exists for it, no committee has heard it, and a revenue picture leaning on video lottery and Deadwood taxes gives incumbents reason to resist a competing product.
One related question keeps coming up
Through the first half of 2026 South Dakota had taken no formal position on federally regulated sports event contracts, unlike the regulators in Nevada, Maryland, Tennessee, New York and New Jersey, several of whom are now in federal court arguing over whether commodities oversight preempts state gambling law.
