Are Offshore Blackjack Sites Legal in Nebraska?
They accept Nebraska players. That is a different thing entirely from being legal, and Nebraska law says so in writing.
No. Offshore blackjack sites are not legal and not regulated in Nebraska. A claim you will see repeated across the internet is that offshore casinos are legal for Nebraska residents because the operator sits outside U.S. borders and Nebraska law cannot reach it. Nebraska law addresses that argument directly and rejects it. Under Neb. Rev. Stat. 28-1110, it is no defense to a gambling prosecution that the gambling was conducted outside the state and was legal in the jurisdiction where it took place. Nebraska is unusual in spelling this out. Any site telling you the offshore location makes it legal in Nebraska is either wrong or not being straight with you.
Why These Sites Accept Nebraska Players
Offshore operators block states based on business risk, not on player legality. There is no known case of Nebraska prosecuting an individual for playing blackjack at an offshore casino. That said, 28-1101(4) does define a person who bets something of value on a chance outcome as engaging in gambling, and 28-1110 closes the offshore loophole.
Financial risk: this is the real exposure
If an offshore casino decides your bonus play violated a maximum bet clause, voids weeks of winnings and closes your account, there is no appeal. If it delays a five figure withdrawal for months while requesting document after document, there is no regulator to escalate to. If it shuts down, your balance goes with it. Money used as a bet in unlawful gambling activity is also subject to forfeiture to the state under Neb. Rev. Stat. 28-1111, which is another reason the “it is all fine because it is offshore” framing is misleading.
Player protection risk: nothing here is enforceable

Why Online Blackjack Is Not Legal in Nebraska
There is no law banning internet blackjack. Nebraska never needed one, because the constitution bans games of chance by default.
The Constitutional Problem
The state constitution prohibits games of chance by default and permits them only where voters have carved out an exception, and every exception so far has been tied to a physical place. Article III, Section 24 of the Nebraska Constitution states that except as provided in that section, the Legislature shall not authorize any game of chance. That is a blanket prohibition with a short list of exceptions, and the Legislature cannot add to the list on its own. Only the voters can, through a constitutional amendment.
This is why gambling expansion in Nebraska moves so slowly compared to other states. In Iowa or Michigan, legalizing online casino games requires a bill and a governor’s signature. In Nebraska it requires a statewide vote first, then implementing legislation, then a regulator writing rules. Every step is a place where the effort can die, and historically most of them have.
The five words that block online play
When Nebraska voters approved Initiative 429 in November 2020, they added subsection 5 to Article III, Section 24. It exempts from the gambling prohibition any law providing for the licensing, authorization, regulation or taxation of all forms of games of chance “when such games of chance are conducted by authorized gaming operators within a licensed racetrack enclosure.” The amendment authorized all forms of games of chance, broad enough to include blackjack in every variant, but confined them to a physical location. A hand of blackjack dealt to a phone in Kearney is not conducted within a licensed racetrack enclosure, so the exception does not reach it and the default constitutional prohibition applies.
This was not an accident or an oversight. During the 2020 campaign, opponents argued in the official Initiative Measures Pamphlet that passage would mean all games of chance become legal “including online slot machines and table games from laptops and cellphones anywhere in Nebraska, 24 hours a day.” That prediction was wrong, and the enclosure language is the reason.
Nebraska Legalized Casinos but Not Online Casinos
The distinction matters because Nebraska is now a genuine casino state by most measures. Five racinos operate, and the Nebraska Racing and Gaming Commission reported a 7.4 percent year over year increase in total casino revenue for July 2026. Through the first seven months of 2026, Nebraska casinos generated roughly $37.5 million in gaming tax revenue, including about $26.3 million directed to the Property Tax Credit Cash Fund.
None of that infrastructure extends online. The Racetrack Gaming Act gives the commission authority over what happens inside licensed enclosures. Extending it to the internet would require voters to amend the constitution again.

How Nebraska Defines Gambling
Under Neb. Rev. Stat. 28-1101(4), a person engages in gambling by betting something of value on the outcome of a future event determined by an element of chance, or on the outcome of a game or contest, unless the activity is authorized under one of the named acts. Those acts are the Nebraska Bingo Act, the County and City Lottery Act, the Lottery and Raffle Act, the Pickle Card Lottery Act, the Small Lottery and Raffle Act, the State Lottery Act and the Nebraska Racetrack Gaming Act.
The Nebraska Supreme Court has held in American Amusements Co. v. Nebraska Dept. of Rev. that an activity is gambling in Nebraska if its outcome is predominantly caused by chance. Blackjack involves genuine strategic decisions, but the cards are dealt at random, and no Nebraska court has ever treated it as a skill game.
Promoting Gambling and What It Means for Operators
The serious penalties target the business side. Under Neb. Rev. Stat. 28-1102, promoting gambling in the first degree covers knowingly advancing or profiting from unlawful gambling by accepting bets totaling $1,000 or more in one day, or receiving more than $1,000 of money played in an unlawful scheme in one day. Possession of gambling records is addressed in 28-1105, and Neb. Rev. Stat. 28-1107 makes possession of a gambling device a Class II misdemeanor.
Are Nebraska Players Breaking the Law?
This is the question most Nebraska blackjack players actually want answered, and the accurate answer requires holding two things at once.

- There is no record of the state prosecuting anyone for it.
Points against
- Section 28-1101(4) does describe the player’s conduct as engaging in gambling.
- Section 28-1110 removes the offshore jurisdiction defense, which few states bother to spell out.
- Section 28-1111 makes money bet in unlawful gambling subject to forfeiture.
- The activity is not affirmatively legal, and no site should tell you otherwise.

The Nebraska Racetrack Gaming Act
The Racetrack Gaming Act, codified beginning at Neb. Rev. Stat. 9-1101, is the framework created by Initiative 430. It established the Nebraska Racing and Gaming Commission, set out licensing categories for authorized gaming operators and gaming operators, and defined what may be offered inside a licensed racetrack enclosure. Initiative 431 attached the 20 percent tax on gross gaming revenue, with 70 percent going to the Property Tax Credit Cash Fund, 25 percent to counties, 2.5 percent to the Compulsive Gamblers Assistance Fund and 2.5 percent to the General Fund.
Nothing in the act contemplates remote or internet play. The Nebraska Racing and Gaming Commission administers Title 296 rules covering casino gaming, sports wagering, responsible gaming and exclusion, and its jurisdiction stops at the enclosure boundary.

Nebraska Online Gambling Timeline: Bills That Passed and Failed
Ninety years of narrow carve-outs, one landmark vote in 2020, and not a single online casino bill in the whole run.
1934 to 2019: the slow carve-outs
Nebraska voters have expanded gambling only in narrow increments, and always by amending the constitution. Pari-mutuel wagering on horse races was authorized in the 1930s, with the Nebraska State Racing Commission established in March 1935. Charitable bingo followed in 1958. Lotteries and raffles for charitable purposes came in 1967. Simulcast horse racing was added in 1988. The state lottery was authorized in 1992 and launched in 1993. Every one of these took a statewide vote. None of them touched casino games.
2016: the first casino petition fails
Keep the Money in Nebraska, backed by Ho-Chunk Inc., the economic development arm of the Winnebago Tribe of Nebraska, sponsored three casino initiatives in 2016 and submitted more than 310,000 signatures. The measures failed to qualify after the Secretary of State rejected roughly 40,000 signatures during verification. The campaign sued its signature gathering contractor.
2020: Initiatives 429, 430 and 431 pass
The same coalition tried again, partnering with the Nebraska Horsemen’s Benevolent and Protective Association, and submitted approximately 470,000 signatures across three petitions in July 2020. On Aug. 25, 2020, Secretary of State Bob Evnen ruled that the measures did not qualify, arguing the constitutional initiative violated the single subject rule. On Sept. 10, 2020, the Nebraska Supreme Court ruled in State ex rel. McNally v. Evnen that they did not violate the rule and ordered them onto the ballot.
On Nov. 3, 2020, all three passed. Initiative 429, the constitutional amendment, was approved 588,405 to 316,298, or 65.04 percent. Initiative 430 created the regulatory framework and the gaming commission. Initiative 431 set the 20 percent tax. The support campaign raised $7.3 million, the bulk of it from Ho-Chunk Inc. Opposition committees, led by Gambling with the Good Life and Keep the Good Life Inc., raised about $2.1 million, including $350,000 from then Governor Pete Ricketts.
2021: LB 561 signed into law
Governor Ricketts signed LB 561 on May 25, 2021, providing the implementing framework for casino gaming and retail sports betting. Crucially, the online provisions were stripped from the bill before passage. LB 561 authorized sports wagering only at licensed racetrack casinos, prohibited wagering on Nebraska college teams, and set no path to mobile play.
2022 and 2023: the market opens
Regulators approved sports wagering rules in October 2022. 2024: LB 13 and the special session fail
A constitutional amendment effort to add mobile sports betting failed during the 2024 session, with 13 senators signing a statement of opposition. Nebraska’s August 2024 special session, called primarily to address property taxes, ended without formally taking up online sports betting. Former Huskers head coach and U.S. Representative Tom Osborne testified against legalizing online wagering on July 31, 2024.
Meanwhile the retail market kept growing. Harrah’s Columbus opened permanently in 2024, WarHorse Omaha opened Aug. 6, 2024 and WarHorse Lincoln’s permanent facility opened Nov. 4, 2024.
2025: LR 20CA advances then stalls
Lincoln Senator Eliot Bostar introduced LR 20CA, a constitutional amendment that would have let voters decide on mobile sports betting in November 2026. Under the proposal, authorized gaming operators conducting sports wagering inside a licensed racetrack enclosure could also offer mobile wagering to bettors physically located inside Nebraska.
Bostar told the General Affairs Committee at a March 10, 2025 hearing that there were more than 83,000 active mobile sports wagering accounts in Nebraska during the 2024-25 football season, a 63 percent increase over the prior year, and that the state was losing roughly $32 million in annual tax revenue. Lance Morgan, chief executive of Ho-Chunk Inc., testified in support.
The committee advanced the measure 6-2 on March 17, 2025 and the full Legislature gave first round approval 27-16 on April 14, 2025. Because opponents promised a filibuster, the measure needed 33 votes at the second stage and 30 at final reading in the 49 member unicameral. Revenue Committee chair Senator Brad von Gillern of Elkhorn led the opposition, distributing materials on gambling related depression, anxiety and bankruptcy and telling colleagues not to “sell out our young people for property tax relief.” Bostar requested the measure be passed over during second round debate on April 23, 2025.
A separate bill, LB 421 from Kearney Senator Stanley Clouse, would have amended the Racetrack Gaming Act to create an online sports betting framework taxed at 20 percent. It received a committee hearing in March 2025 and did not advance.
2026: LR 20CA postponed and LB 1001 signed
Nebraska operates on a two year legislative cycle, so both LR 20CA and LB 421 carried over into the session that began Jan. 7, 2026. Neither passed. LR 20CA was indefinitely postponed in April 2026, ending the legislative route.
The Legislature did pass LB 1001, introduced by the General Affairs Committee at the request of the Racing and Gaming Commission and approved by the governor on March 16, 2026 after advancing 37-0 on Feb. 9, 2026. It transferred oversight and funding of the Nebraska Commission on Problem Gambling from the Department of Revenue to the Racing and Gaming Commission, added annual gaming tax proceeds as a funding source for treatment and prevention, allowed racetracks to petition for waivers of minimum live racing day requirements due to natural events, updated simulcasting and licensing rules, and allowed 19-year-olds to play keno at licensed racetrack enclosures in an area separate from the casino floor. It contained nothing on online casino gaming.
August 2026: two online sports betting measures certified
With the legislative path closed, the casino industry ran the petition route. Both measures were cleared for circulation in February 2026, and organizers submitted nearly 350,000 signatures across the two proposals by the July 3, 2026 deadline. On Aug. 21, 2026, the Nebraska Secretary of State’s Office confirmed that both qualified for the Nov. 3, 2026 general election ballot.
Officials identified some potentially fraudulent petition signatures during verification. Those were excluded from the valid totals used to certify the measures. The Secretary of State’s Office will hold public hearings in each of Nebraska’s three congressional districts, and the final statewide ballot must be certified by Sept. 11, 2026.

Rosebud Casino, operated by the Rosebud Sioux Tribe, sits on the Nebraska and South Dakota line near Valentine and carries more than 250 machines plus live table games. The Winnebago Tribe’s largest property, WinnaVegas Casino Resort, is in Sloan, Iowa.
Why Class II Gaming Means No Tribal Blackjack
Nebraska’s in-state tribal venues operate Class I and Class II gaming under the Indian Gaming Regulatory Act, regulated by the National Indian Gaming Commission. None of the racinos operates a dedicated poker room. Blackjack is the engine of Nebraska’s table game business. In April 2026, blackjack accounted for more than $680,000 of revenue at WarHorse Lincoln alone, against $1.5 million in total table game revenue across all five casinos that month. In July 2026 table games produced $2.5 million statewide, with electronic table games adding $559,033.
Crossing State Lines to Iowa
A significant share of Nebraska blackjack play still happens in Council Bluffs, where three Iowa casinos sit within sight of downtown Omaha. Nebraska has done none of this. But the state’s General Affairs Committee has been active on gaming legislation each session, and Nebraska’s constitutional structure gives lawmakers more room to restrict gambling than to expand it. A restriction requires only a bill, while an expansion requires a statewide vote. Nebraska players should treat continued sweepstakes access as likely but not guaranteed, and should redeem eligible Sweeps Coin balances promptly rather than letting them accumulate.

The Racing and Gaming Commission would have to establish online sports betting rules by June 1, 2027, and the statutory measure becomes operative Jan. 1, 2027.
Existing law taxes gross gaming revenue from authorized gaming operators at 20 percent, with 70 percent of proceeds going to the Property Tax Credit Cash Fund and additional portions to problem gambling programs, the General Fund and local governments. Supporters point to Nebraska’s modest retail sports betting numbers as evidence of leakage. State racetrack casinos produced about $9.3 million in sports betting revenue in 2025, generating less than $2 million in taxes, and July 2026 retail sports betting revenue was $574,488.
The Realistic Timeline for Nebraska iGaming
Working backward from what actually has to happen, online blackjack in Nebraska is a long way off.
A new constitutional amendment
Step one would be an amendment specifically authorizing games of chance conducted outside a licensed racetrack enclosure, or at least deeming online play to occur within one. No such measure exists, no senator has introduced one, and no petition campaign has been organized around it.
Implementing legislation
LB 561 took from November 2020 to May 2021 to pass, and the online provisions were removed even then.

Then rulemaking by the Racing and Gaming Commission, followed by licensing and platform certification. Nebraska’s retail sports betting took from May 2021 to June 2023 to launch after legalization, roughly two years for a far simpler product.
The optimistic arrival date
Even on an optimistic path where a casino amendment reached the 2028 ballot and passed, launch would realistically fall in 2030 or later. Nothing currently in motion puts a measure on the 2028 ballot.
What Stands in the Way
Several factors make Nebraska one of the least likely states to authorize online casino games this decade.
