What “not legal” means for a California player

There is an important distinction here that gets blurred on a lot of pages. Penal Code 330 is written to target the people who deal, open, conduct or carry on a prohibited game. It does also cover “every person who plays or bets at or against any of those prohibited games,” so a player is technically within the statute’s reach. The penalty is a misdemeanor carrying a fine of $100 to $1,000, up to six months in county jail, or both.

In practice, California has never prosecuted an individual for playing blackjack on an offshore website. State enforcement energy goes toward operators, and in 2025 and 2026 it went almost entirely toward cardrooms, sweepstakes companies and daily fantasy sports operators. That is a description of enforcement history, not a legal opinion, and it is not a guarantee. Why offshore sites are the main real money blackjack option in California

Strip out everything illegal or unavailable and a California resident has three ways to play blackjack for money: drive to a tribal casino, drive to a cardroom and play a modified version of the game, or play offshore online. There is no fourth option. Sweepstakes blackjack was the closest thing to a legal online workaround and the Legislature closed it.

That is why offshore sites dominate the California online blackjack market by default rather than by merit. They are not the best option. They are the only online option.

Blackjack is named by name in Penal Code 330

Penal Code Section 330 makes it a misdemeanor to deal, play, carry on, open or conduct “any game of faro, monte, roulette, lansquenet, rouge et noire, rondo, tan, fan-tan, seven-and-a-half, twenty-one, hokey-pokey, or any banking or percentage game played with cards, dice, or any device.” The statute dates to 1872 and has been amended, but “twenty-one” has never come off the list. The Bureau of Gambling Control leaned on that word directly in its 2026 rulemaking, arguing that “twenty-one” and “blackjack” have been used interchangeably for decades in common usage, in California and federal court decisions, and under the federal Indian Gaming Regulatory Act.

Tribal exclusivity over banked card games

The second obstacle is constitutional. Article IV, Section 19 of the California Constitution prohibits casinos of the type operating in Nevada and New Jersey. Subdivision (f), added by Proposition 1A in 2000, carves out an exception allowing federally recognized tribes to operate slot machines, lottery games, and banking and percentage card games on tribal land under compacts negotiated with the governor. That exception is the entire legal basis for house-banked blackjack in California, and it belongs to the tribes alone. California’s tribal gaming industry generated roughly $12.1 billion in fiscal 2024, more than any other state’s. The California Nations Indian Gaming Association puts the broader economic contribution near $25 billion and more than 112,000 jobs. An industry that size does not volunteer to share an exclusive right, and it has the political resources to defend it.

Legalization requires a constitutional amendment, not just a bill

This is the point most people miss. Because Article IV, Section 19 is a constitutional prohibition, expanding gambling requires amending the constitution, and that requires a statewide vote. The California Supreme Court settled this in 1999. Voters had passed Proposition 5 in November 1998 by a 63 percent margin, authorizing Class III tribal gaming by statute. The court struck it down in Hotel Employees and Restaurant Employees International Union v. Davis, holding that a statutory initiative could not authorize what the constitution prohibited. Tribes had to go back to voters in March 2000 with Proposition 1A, a constitutional amendment, to get the result Proposition 5 was supposed to deliver. There is no legislative shortcut.

The tribal and cardroom war that blocks everything else

Tribes say cardrooms run illegal house-banked games. Cardrooms say their player-dealer model has been lawful under multiple attorneys general, including Kamala Harris. Cities say cardroom taxes fund their police and fire departments. Neither side can move an online gambling measure without the other spending against it. Until that fight resolves, nothing else advances.

Why tribes have exclusivity over banked blackjack

Because voters gave it to them. Proposition 1A amended the state constitution in March 2000 specifically to permit banking and percentage card games on tribal land under compacts, and nowhere else. Tribes negotiated compacts with the governor, ratified by the Legislature, in exchange for revenue-sharing obligations and regulatory commitments. Part of that revenue flows through the Revenue Sharing Trust Fund, which distributes money from gaming tribes to non-gaming tribes that lack the location or resources to operate a casino. This matters for the online question: any future online framework has to account for tribes that have no casino but currently receive a share of gaming revenue, which is one of the harder internal problems tribal leaders have to solve before going to voters.

Could tribes ever offer online blackjack in California?

This is the most likely route to legal online blackjack in the state, and tribal leaders have said as much. The consensus emerging from CNIGA and individual tribal governments is that any future ballot measure would probably combine retail and online sports betting with provisions for online casino gaming, all under tribal control. The obstacles are real. All 109-plus California tribes would need to be substantially on board, including non-gaming tribes. Commercial operators would need to accept a subordinate role after spending more than $150 million losing Proposition 27. And voters, who rejected online gambling by 82 percent four years ago, would need to change their minds.

How the player-dealer and third-party proposition players work

Penal Code 330.11 requires the dealer position to rotate among players. In theory, any player at the table can take the bank. In practice, most players decline, because banking requires enough money to cover every other player’s bet. That gap is filled by third-party proposition player services, or TPPPs. These are separately licensed businesses that station bankrolled employees at tables to accept the player-dealer position when it is offered and no one else takes it. The TPPP is not the house, is licensed and regulated by the state, and takes the same risk any player-dealer takes. Tribes have argued for more than a decade that this is a legal fiction and that a TPPP that always banks is functionally the house. That disagreement is the entire dispute.

The 2026 attempt to ban blackjack in cardrooms

In February 2026 the Bureau of Gambling Control finalized rules that would have ended the arrangement. The blackjack regulation would have barred approval of any game using 21 as its target, allowing players to bust, paying a natural bonus, or using the blackjack name. The rotation regulation would have required the player-dealer position to move to at least two non-TPPP players every 40 minutes or the table would close. The industry response was immediate. Cities that depend on cardroom taxes declared fiscal emergencies. Labor unions filed opposition, noting that previous attorneys general, including Kamala Harris, had concluded cardroom games were lawful. Operators said the rules would eliminate more than half of cardroom jobs.

The 2026 ballot came and went without a gambling measure. CNIGA confirmed in January 2025 that tribes would not pursue a 2026 initiative, and Chairman Siva has restated the position repeatedly since, most recently in August 2026. No qualifying measure exists.

Tribal leaders have consistently named November 2028, and the emerging shape of that measure would combine retail and online sports betting with online casino provisions, all tribally controlled. Tribes polled California voters in June 2026 to inform a campaign, which indicates real preparation rather than rhetoric. Siva has been blunt about why the timeline is long: 83 percent of voters rejected Proposition 27, and a campaign cannot be built on the same assumptions that produced that result. Qualifying a constitutional amendment requires hundreds of thousands of valid signatures, and the campaign itself would cost well into nine figures.
