The West Virginia Lottery Commission is the sole gaming regulator in the state. It licenses operators, management services providers, suppliers and individual employees. It approves each game before it can be offered. It audits operators, collects the weekly tax, maintains the statewide self-exclusion list and can fine, suspend or revoke a license. An operator license under the act costs $250,000, runs five years and renews at $100,000. Management services providers pay $100,000 annually. Suppliers pay $10,000 annually. Individual employees in covered roles must hold occupational licenses, and the statute makes it a misdemeanor for a licensee to employ someone in a licensed position who does not hold a valid license.

The act also makes it a misdemeanor for a licensee to operate without commission authority, to operate in a manner the commission has not approved, or to knowingly allow play on equipment that has been tampered with or configured to deceive the public. Those provisions are the legal backbone behind the promise that the blackjack you play is the blackjack the lab certified.

Every certified blackjack game must publish its rules and, in most cases, its theoretical return. This is one of the practical advantages of playing a licensed West Virginia blackjack site over an offshore one, because the rule set is fixed and auditable rather than adjustable behind the scenes.

The Lottery Commission regulates licensed operators. The attorney general goes after the ones without licenses. Since taking office in January 2025, Attorney General JB McCuskey has made unlicensed online gambling a priority, using investigative subpoenas rather than waiting for new legislation. That distinction matters, because a subpoena is a formal legal demand for documents with penalties for noncompliance, not a warning letter. The office’s stated framing has been consistent: protect consumers, especially minors, from illegal gambling operations while supporting the operators that are licensed and paying tax.

West Virginia has no federally recognized Native American tribes, no tribal trust land and no gaming compacts. That is unusual among states with legal gambling and it is the single biggest structural difference between West Virginia’s market and those in states like Connecticut, Oklahoma, Florida or Washington, where tribal governments are the dominant gaming operators and compacts often restrict what commercial online operators may offer.

The federal Indian Gaming Regulatory Act, which governs tribal gaming nationally, simply has no application here. There is no tribal-state compact to negotiate, no revenue sharing arrangement and no exclusivity clause that a commercial online casino could violate.

West Virginia has never passed a law banning sweepstakes casinos. There is no statute that names them, no bill that outlawed them and no regulation that specifically addresses the dual-currency model. Despite that, more than 40 sweepstakes platforms now list West Virginia as a restricted jurisdiction, and nearly every recognizable national brand has stopped offering prize play to state residents.

This happened through enforcement rather than legislation. The state’s position is that the sweepstakes model, when it involves prize, chance and consideration, falls under existing law as either unlawful betting on games of chance under Section 61-10-5 or an illegal lottery under Section 61-10-11, and that offering it without a license under Article 22E is unlawful interactive wagering.

In late January 2025, reports emerged that newly elected Attorney General JB McCuskey was preparing subpoenas or cease-and-desist letters targeting sweepstakes operators serving West Virginians. He did not confirm the specifics but issued a statement saying his office had serious concerns about West Virginia consumers, and particularly children, being targeted by illegal gambling operations, and that his priority from day one was protecting consumers while supporting operators working within the law. The subpoenas were served shortly afterward, in his first days in office.

The industry pushed back. The Social and Promotional Games Association argued that free-to-play social sweepstakes games are a legally compliant form of entertainment and that McCuskey was conflating them with real money gambling.

The state escalated anyway. Speaking at the National Council of Legislators from Gaming States summer meeting in July 2025, McCuskey said he had issued 47 subpoenas to sweepstakes operators and that none had formally responded, but that 19 had already left the state. Independent tracking put the number higher, at more than 20 exits at the time, with brands including McLuck, Hello Millions, Mega Bonanza, Pulsz, PlayFame, Funrize, Modo, High 5 Casino, Stake.us and the A1 Development affiliates eventually restricting West Virginia. Subpoenas are a stronger tool than the cease-and-desist letters used in states like New York, because they are formal legal demands for documents with penalties attached for noncompliance.

The most significant departure came in November 2025, when VGW, the largest operator in the sector, ended prize play in West Virginia across Chumba Casino, LuckyLand Slots and Global Poker. The phaseout ran in three stages.

VGW described the decision as based on a range of factors. It fit a broader retreat, since the company had already ended Sweeps Coins play in Connecticut, Montana, New Jersey, New York, Louisiana, Mississippi, Washington, Michigan, Delaware, Idaho and Nevada. Once Chumba and LuckyLand pulled out, more than 40 platforms excluded West Virginia.

A small number of holdouts have continued to accept West Virginia players, and the roster changes without notice. Because availability shifts week to week and because an operator’s marketing pages are often out of date, the only reliable check is the platform’s own terms and conditions. Go directly to the terms page, search for West Virginia, WV or the restricted states list, and see whether the state appears. If it does, prize play is not available to you regardless of what a review page says.

Two other points are worth understanding. Sweepstakes casinos are not licensed by the West Virginia Lottery Commission, so there is no state complaint process if a redemption is denied.
