Kansas answered the internet gambling question in writing 30 years ago, and the answer has never been withdrawn.
Not Licensed and Not Regulated in the United States
No offshore blackjack site holds a Kansas license. None of them are regulated by any American authority. What Kansas Law Actually Says About Placing an Online Bet
This is where Kansas differs from most states, and where most Kansas online blackjack pages get it wrong.
Kansas criminal law defines gambling at K.S.A. 21-6404, and the definition is short. Gambling is making a bet, or entering or remaining in a gambling place with intent to make a bet, participate in a lottery or play a gambling device. Gambling is a class B nonperson misdemeanor.
Note who that statute applies to. It is not aimed at the operator. The operator provisions are separate, at K.S.A. 21-6406, which makes commercial gambling a severity level 8 nonperson felony. K.S.A. 21-6404 applies to the gambler. The Kansas Racing and Gaming Commission says so directly in its own illegal gambling guidance: the crime of gambling applies to the gambler, and conviction can carry up to six months in jail, a fine up to $1,000 or both.
A bet is defined at K.S.A. 21-6403 as a bargain in which the parties agree that, depending on chance, one stands to win or lose something of value. Real money blackjack fits that definition without much argument.
The 1996 Kansas Attorney General Opinion on Internet Betting
In Attorney General Opinion 1996-031, issued March 25, 1996, the office was asked whether gambling at virtual casinos located outside Kansas would be legal if the computer used to place the bet was inside the state. The answer was no. The opinion concluded that placing, receiving or forwarding a bet and participating in a lottery over the internet violates Kansas criminal gambling statutes, and that if a bet is placed from a computer located in Kansas, any person or entity participating may be prosecuted in Kansas.
An attorney general opinion is not binding law in the way a statute or a court ruling is. It is the state’s official legal interpretation, and it has never been withdrawn. So when other sites tell you that Kansas law does not reach offshore casinos because the operator is overseas, understand that the state of Kansas has formally taken the opposite position for 30 years. The offshore location of the server does not move the location of the bettor.
Has Kansas Ever Prosecuted an Online Blackjack Player?
There is no record of Kansas charging an individual for playing casino games at an offshore site. Enforcement resources have gone toward operators, illegal gambling machines and unlicensed commercial operations, not toward players sitting at home. The KRGC’s 2024 cease-and-desist campaign against a major offshore operator is the clearest example of where the state actually puts its effort, and its enforcement attorney framed it explicitly as consumer protection rather than player prosecution.

What a Curacao or Anjouan License Really Gets You
Something, but far less than it sounds. These jurisdictions verify corporate existence and collect fees. They do not enforce American consumer protection standards, do not require the segregation of player funds from operating funds in the way regulated markets do, and do not run a meaningful dispute process for foreign players. Curacao restructured its licensing regime in recent years and now issues licenses under the Curacao Gaming Authority with numbers you can look up, which is an improvement in transparency but not in enforcement power.
Anjouan licenses, common among the RTG brands listed above, sit further down the credibility scale still.
The Real Risks: Payouts, Disputes and No Recourse
The thing that goes wrong at offshore casinos is almost never a rigged blackjack shoe. It is the cashier. Common failure points:
- A withdrawal enters review and stays there while the operator requests progressively more documentation.
- A bonus term you did not notice, such as a maximum bet during playthrough, voids winnings retroactively.

Why Online Blackjack Is Not Legal in Kansas
Most states need a bill. Kansas needs a bill that solves a constitutional ownership problem first.
The Constitutional Barrier in Article 15
Kansas has a structural problem that most states do not. Article 15, Section 3 of the Kansas Constitution, adopted at the 1859 constitutional convention and approved by voters that year, prohibited lotteries and the sale of lottery tickets in Kansas permanently. Every expansion of gambling in Kansas since has required either a constitutional amendment or a carefully drafted workaround.
The 1986 amendment that created the Kansas Lottery did not simply legalize gambling. It authorized a lottery owned and operated by the state. That ownership language is why Kansas casinos are structured the way they are.
The State Ownership Requirement Explained
When Kansas authorized four casinos under the 2007 Kansas Expanded Lottery Act, it could not license private casino companies the way Nevada or New Jersey does. Instead, the Kansas Lottery legally owns the gaming operations at Boot Hill, Hollywood Casino at Kansas Speedway, Kansas Star and Kansas Crossing. Private companies including Boyd Gaming and Penn Entertainment operate them under management contracts. The slot machines and table games at those properties belong to the state.
This is the single biggest obstacle to online blackjack in Kansas. Any iGaming framework would have to route through the Kansas Lottery as owner rather than through a conventional licensing model. That is a heavier legislative lift than the copy-and-paste bills that have moved in other states, and it is a large part of why Kansas has not even seen a serious attempt.
How Kansas Defines Gambling and a Bet
The default rule in Kansas is that all gambling is illegal unless a statute specifically authorizes it and a state agency regulates it. The authorized exceptions are narrow: the state lottery, state-owned casinos, tribal gaming under compact, licensed charitable bingo and raffles, pari-mutuel wagering, and sports betting. Online casino games are not on that list, which means they fall under the general prohibition by default rather than by any bill that singled them out.
Why Sports Betting Was Carved Out and Casino Games Were Not
Senate Bill 84, signed by Gov. Laura Kelly in May 2022, was drafted narrowly, and the line it drew still holds.

- Each of the four state-owned casinos contracting with up to three online sportsbook operators.
- A tax set at 10 percent of revenue.

That narrowness was deliberate. Sports betting had a clean legislative story after the Supreme Court struck down the federal ban in 2018, and it fit into the existing Lottery ownership structure without much strain. Online casino gaming would compete directly with the state’s own brick-and-mortar casino revenue and with tribal gaming, and neither constituency has pushed for it.
The Political Climate in Topeka
Kansas lawmakers are not currently frustrated that online casinos are missing. They are frustrated that sports betting has not produced the revenue they expected at a 10 percent tax rate, one of the lowest in the country. That frustration produced the 2025 contract moratorium described below. The mood in Topeka is toward extracting more from the gambling that already exists rather than authorizing more of it.
Kansas Online Gambling Timeline: Laws, Bills and Failed Attempts
Every expansion of Kansas gambling has had to work around a constitutional prohibition written before statehood.
Lotteries banned in the state constitution
Delegates to the Wyandotte constitutional convention wrote a permanent prohibition on lotteries into Article 15, Section 3. Voters approved it that year. Kansas entered the union in 1861 with gambling constitutionally banned.
Voters approve a state-owned lottery
More than 60 percent of Kansas voters approved a constitutional amendment authorizing a state-owned and state-operated lottery. The Kansas Lottery began selling tickets in 1987. The ownership language in that amendment shaped everything that followed.
Four tribal gaming compacts approved
Kansas negotiated tribal-state gaming compacts with the four tribes holding reservations in the state, all in the northeast corner: the Iowa Tribe of Kansas and Nebraska, the Kickapoo Tribe of Indians of the Kickapoo Reservation in Kansas, the Prairie Band Potawatomi Nation and the Sac and Fox Nation of Missouri in Kansas and Nebraska. The Legislature approved all four in 1995 and the Bureau of Indian Affairs signed off. The compacts are codified at K.S.A. 74-9802. The Kansas State Gaming Agency was created the same year to provide state oversight.
March 1996: the attorney general rules on internet gambling
Opinion 1996-031 concluded that placing a bet over the internet from a computer located in Kansas violates state criminal gambling statutes. The opinion predates every offshore casino now serving Kansas players and has never been withdrawn.
1996 to 1998: tribal casinos open
The Kickapoo Tribe opened Golden Eagle Casino in May 1996, the first tribal casino in Kansas. Sac and Fox Casino followed in February 1997. The Prairie Band Potawatomi Nation opened a temporary facility in October 1996 and the permanent Harrah’s Prairie Band Casino in January 1998. The Iowa Tribe opened a temporary facility in May 1998 and Casino White Cloud that December.
Compact renegotiations stall
The Kickapoo and Sac and Fox tribes proposed a $210 million casino and hotel near Kansas Speedway, and Gov. Kathleen Sebelius negotiated a compact that would have shared revenue with the state for the first time. The Legislative Coordinating Council declined to act in November 2004, and the deal did not survive.
The Kansas Expanded Lottery Act
The Legislature authorized four state-owned casino zones and permitted Kansas Lottery slot machines at racetracks. Because of the constitutional ownership requirement, the games would be owned by the Lottery and merely managed by private operators. The same year, the Prairie Band Potawatomi Nation took over management of its casino from Harrah’s on July 1, 2007, and renamed it Prairie Band Casino and Resort.
2009 to 2017: the four state-owned casinos open
Boot Hill Casino and Resort in Dodge City opened phase one in December 2009 as the first state-owned gaming facility in Kansas. Kansas Star Casino in Mulvane opened a temporary facility Dec. 26, 2011, with the permanent building following in December 2012. Hollywood Casino at Kansas Speedway opened Feb. 3, 2012. Kansas Crossing Casino in Pittsburg opened to the public March 31, 2017, and held its grand opening April 8, 2017, completing the four authorized zones.
An expansion bill carries an online gambling ban
A gambling expansion bill introduced that session included an amendment that would have explicitly banned online gambling in Kansas. The bill failed, so the ban never took effect, but the amendment itself is a useful signal. The instinct in Topeka when internet gambling came up was to prohibit it rather than license it.
Fantasy sports carved out
The Legislature excluded qualifying fantasy sports leagues from the statutory definition of a bet, provided the league meets specific conditions. This remains the only internet-based gaming carve-out Kansas made before sports betting.
2020 and 2021: the Wyandotte Nation expands
In May 2020 the United States Department of the Interior agreed to acquire land in trust for the Wyandotte Nation of Oklahoma in Park City, Sedgwick County. Construction on CrossWinds Casino began in October 2020 and the property opened March 2, 2021, initially as a Class II facility, which meant slot-style machines but no Class III table games.
May 2022: SB 84 legalizes sports betting
Gov. Laura Kelly signed Senate Bill 84, creating a legal framework for retail and online sports wagering overseen by the Kansas Lottery and the Kansas Racing and Gaming Commission. Each of the four state-owned casinos could partner with up to three online sportsbook operators, allowing for as many as 12 online skins. Wagering launched Sept. 1, 2022, with Kelly placing a ceremonial first bet at Hollywood Casino.
2023 and 2024: tribal sports betting compacts
The Legislature approved compact amendments allowing tribal casinos to offer sports wagering. Prairie Band Casino opened the first tribal sportsbook in Kansas in January 2024. Compacts covering Sac and Fox Casino and Casino White Cloud were approved in 2023 and 2024 respectively. In practice, uptake has been limited, with the Prairie Band Potawatomi Nation the only tribe running a full sportsbook operation. The Kickapoo Tribe did not amend its compact for sports wagering.
July to September 2024: Kansas pushes a major offshore casino out
The Kansas Racing and Gaming Commission sent a cease-and-desist notice to Bovada on July 8, 2024. Delivery was confirmed Aug. 20. The operator did not acknowledge the letter but added Kansas to its restricted list by late September 2024. A KRGC official framed the action as protecting Kansas bettors and steering them toward licensed, regulated and taxed sites, particularly on questions of getting paid. This is the most consequential Kansas development for offshore blackjack players in the last decade, and it happened without a single new law being passed.
April 2025: SB 125 freezes sportsbook contracts
On the final day of the session, the Legislature attached a provision to budget bill SB 125 barring the Kansas Lottery from spending state money to negotiate, renew or extend any sports wagering management contract through the fiscal year ending June 30, 2026. Gov. Kelly issued a line-item veto. The Legislature overrode it. The provision did not outlaw sports betting, but it froze the market. Only six of the 12 available online sportsbook slots were filled, and no new entrants could be added during the freeze. Existing operator licenses run to late August 2027. The subtext was a legislature unhappy with a 10 percent tax rate and looking for leverage before the next contract cycle.
March 31, 2026: the Wyandotte Nation compact
Gov. Kelly and Wyandotte Nation Chief Billy Friend signed an updated tribal-state gaming compact authorizing Class III gaming at the Wyandotte Nation’s 7th Street Casino in Kansas City and CrossWinds Casino near Park City. The previous agreement dated to 1995. Chief Friend described the goal as putting the Wyandotte Nation on equal footing with the other tribes and the commercial casinos, including the ability to evaluate sports betting.
2026 session: no online casino bill
The 2026 Kansas legislative session adjourned April 10 without a single online casino bill being introduced, let alone heard in committee. There was no iGaming study, no interim committee assignment and no announced plan to take the issue up. A casino smoking ban, House Bill 2252, drew more attention than online gaming did and still did not become law.
June 30, 2026: the moratorium expires
The SB 125 freeze lapsed at the end of the fiscal year. The Kansas Lottery regained the ability to negotiate sportsbook contracts. The debate now is about the tax rate and the number of operators for the next contract term, not about adding online casino games.

Could Kansas Tribes Offer Online Blackjack?
Not to the general public under current compacts. Tribal gaming compacts in Kansas authorize Class III gaming at physical facilities on tribal land. They do not authorize statewide internet gaming, and nothing in the sports betting amendments changed that.
A tribal route to online blackjack would require new compact negotiation, legislative approval and federal review, and would likely need to resolve the same constitutional ownership question that complicates a commercial framework.
