Are Online Blackjack Sites Legal in Illinois?
No. No site offering real money blackjack to Illinois residents holds an Illinois license, because Illinois has never created one.
Illinois
Not legal. Offshore sites only. The Illinois Gaming Board has issued cease-and-desist letters to offshore operators, but every letter so far has been addressed to a company rather than a player.
Any site you can reach from an Illinois address that deals real money blackjack is operating from outside the United States, outside the reach of the Illinois Gaming Board and outside any American consumer protection regime.
The relevant law is the Illinois Criminal Code at 720 ILCS 5/28-1. It makes gambling a Class A misdemeanor and lists every authorized exception. Casino gambling on a licensed riverboat or in a licensed casino is an exception. Racetrack gaming under an organization gaming license is an exception. Sports wagering under the Sports Wagering Act is an exception. Video gaming under the Video Gaming Act is an exception. Online casino games are not on the list.
That gap is not an accident of drafting. Lawmakers have filed an Internet Gaming Act in four straight sessions, and it has died in committee every time. When the spring session adjourned June 1, 2026, online casino gaming was not in the one gambling bill that did pass.

That is the complete list. There is no legal online blackjack anywhere in it.
Why Offshore Sites Are the Main Real Money Blackjack Option in Illinois
Because nothing else fills the gap. A handful of offshore casinos, most of them registered in Curacao, Costa Rica, Panama or Anjouan, have taken American customers for 15 years or more and continue to accept Illinois signups. Illinois players need to know two specific things. First, Bovada still accepts Illinois, and Illinois is not on its restricted list, which as of mid-2026 covers roughly 20 states and Washington, D.C., all of them states that regulate sports betting or have pushed back directly. Second, the Illinois Gaming Board issued a cease-and-desist letter to Harp Media B.V. covering Bovada.lv and Bovada.com on Feb. 3, 2025, over unlicensed sports wagering, and named a Bovada-linked casino brand in its Feb. 4, 2026, casino letters. Those letters are directed at the operator, not at players, but they show Illinois regulators know exactly who Bovada is.
Practical notes: crypto withdrawals are the fastest route, the site self-hosts its mobile app rather than distributing through app stores, and any app claiming to be Bovada in Google Play or the App Store is not.
2. Ignition Casino

Where Slots.lv earns a place on an Illinois list is reliability. Casino Max is a smaller, casino-only brand running on Real Time Gaming software, which gives it a distinctly different blackjack catalog from everything else on this list. RTG’s blackjack titles include Perfect Pairs, Match Play 21, Super 21 and Pontoon, so if you want variants you cannot find at Bovada, this is where they are.
It accepts Illinois players and has not been named in Illinois enforcement. Live dealer is limited or absent depending on the period, so this is an RNG blackjack site.
The caution is size. Casino Max does not have the volume, the track record or the payment redundancy of the larger brands here, and RTG-platform casinos as a category have a mixed reputation on withdrawal speed. Are Offshore Blackjack Sites Legal in Illinois?
No. They are not legal and they are not regulated. They accept Illinois players anyway, and the difference between those two facts is the most useful thing on this page.
What the Illinois Statute Actually Says
720 ILCS 5/28-1 splits the offense. Subsections (a)(1) and (a)(2) describe the player: knowingly playing a game of chance or skill for money, or knowingly making a wager on the result of any game or contest. Subsection (a)(12) describes the operator: knowingly establishing, maintaining or operating an internet site that lets a person play a game of chance or skill for money over the internet, or make a wager over the internet.
Gambling is a Class A misdemeanor in Illinois, carrying up to a year in county jail. A second or subsequent conviction under subsections (a)(3) through (a)(12) is a Class 4 felony. The statute lists 15 exceptions in subsection (b), and none of them covers online casino games.
The state’s authorization structure is spelled out in the Illinois Gambling Act at 230 ILCS 10, the Video Gaming Act at 230 ILCS 40 and the Sports Wagering Act at 230 ILCS 45. You can read the current text of all of them at the Illinois General Assembly website.
What Illinois Regulators Have Actually Done
Enforcement has been aimed squarely at operators. The Illinois Gaming Board publishes its cease-and-desist letters, and the pattern is clear.
On Feb. 3, 2025, the board wrote to Harp Media B.V., doing business as Bovada.lv, Bovada.com and Bovado.com. On Feb. 11, 2025, it sent 10 more to unlicensed sports wagering and fantasy operators, including BetOnline.ag, betus.com.pa, Bookmaker.eu, betanysports.eu, heritagesports.eu, parlayplay.io and others. The board has also written to prediction market operators, including Kalshi, Robinhood and Crypto.com in April 2025 and Polymarket in January 2026.
Then on Feb. 4 and 5, 2026, the board and Attorney General Kwame Raoul issued 65 cease-and-desist letters on the casino side, citing 720 ILCS 5/28-1(a)(12). That batch was overwhelmingly sweepstakes operators, but it included at least one Bovada-linked casino brand.
Every letter is addressed to a company. There is no publicly reported case of Illinois charging an individual resident for playing blackjack at an offshore online casino.
What That Means for You in Plain Terms
The realistic risk is financial, not criminal
The state is going after the businesses. That does not make playing legal, and this page is not going to tell you it does. What it means practically is a frozen balance, a voided bonus, a withdrawal that takes six weeks, or a site that adds Illinois to its restricted list on a Tuesday and leaves you redeeming a balance you can no longer play.

Why Online Blackjack Is Not Legal in Illinois
Illinois has no moral objection to gambling. The reason online blackjack keeps failing is arithmetic and lobbying, not principle.
The state sells lottery tickets online, licenses sports betting, runs more gaming terminals in bars than any state in the country and has spent 35 years steadily expanding legal gaming.
The 2019 Expansion Legalized Sports Betting Only
Gov. J.B. Pritzker signed the state’s largest gambling expansion in a generation on June 28, 2019. It authorized a Chicago casino, five additional casino licenses, sports betting, and slot machines at racetracks. It did not authorize online casino games. When online sportsbooks went live in Illinois in 2020, they came with a sports-only license, which is why the casino tab inside a legal Illinois betting app is switched off inside state lines.
The Video Gaming Terminal Industry Is the Main Obstacle
Illinois has close to 8,700 licensed video gaming establishments running roughly 48,700 terminals. Those machines sit in bars, restaurants, truck stops and fraternal clubs in nearly every legislative district in the state, and the industry behind them is worth billions in annual revenue. Its argument in Springfield is straightforward: an online casino on every phone would pull players away from the machine in the corner of the neighborhood bar.
That argument lands because VGT revenue is distributed. Municipalities get a cut. Local businesses get a cut. A legislator hearing from a dozen bar owners in the district is hearing from constituents, not from a corporate lobbyist.
Labor Unions and Casino Operators Have Opposed It
Against legalization
- The video gaming terminal industry, in nearly every legislative district.
- Hospitality unions, on the ground that online play cannibalizes the floor jobs their members hold.
- Penn Entertainment, which testified against the 2025 bill and told the House Gaming Committee it had invested more than $600 million in its Alton, Joliet and Aurora properties on the expectation that the state’s gaming landscape would stay stable.
For legalization
- Caesars and MGM, which run iGaming platforms in other states.
- The Sports Betting Alliance, representing BetMGM, DraftKings, FanDuel and Fanatics, which pushed hard for the 2026 bill.
- Attorney General Kwame Raoul, who has said publicly that he expects the state to legalize online casinos eventually.
Not every operator opposes it. The industry is split, which is part of why nothing passes.
The Committee Math Has Never Worked
House Gaming Committee Chair Dan Didech said during the 2025 hearing that any iGaming bill faced a long road because opponents’ concerns were well founded. That assessment has held. The bill has never received a floor vote in either chamber, in any session.

Tribal Gaming in Illinois and What It Means for Blackjack
Illinois is a large Midwestern state with a long tribal history and, until 2024, no federally recognized tribal land at all.
That changed in 2024, and the story is worth understanding because it is the one plausible path to a form of legal gaming in Illinois that does not run through the General Assembly.
The Prairie Band Potawatomi Nation and the Shab-eh-nay Reservation
1829 to 1859: the treaty and the illegal sale
Chief Shab-eh-nay’s reservation in what is now DeKalb County was guaranteed by treaty in 1829. In 1849, while he was in Kansas visiting family, the federal government illegally sold 1,280 acres of it at auction. Neither Shab-eh-nay nor his heirs ever recovered the land or received compensation before his death in 1859.
2006 to 2014: repurchase and trust application
The Prairie Band Potawatomi Nation, now headquartered in Mayetta, Kansas, repurchased about 128 acres inside the historic reservation boundary in 2006 and filed to have it placed into trust in 2014. The tribe maintains a detailed account of the claim on its Shab-eh-nay history page.
April 19, 2024: land into trust in DeKalb County
The Department of the Interior placed 130 acres into trust for the nation. That transfer confirmed the land as Indian country, gave the tribe jurisdiction over it and made the Prairie Band Potawatomi Nation the only federally recognized tribal nation with land in Illinois.
2025: the Shabbona Lake State Park transfer
The Illinois House passed Senate Bill 867 by a vote of 63-41 on Jan. 7, 2025, and Pritzker signed it in March. The law authorized the Department of Natural Resources to transfer title to Shabbona Lake State Park, roughly 1,500 acres that largely overlap the original reservation, to the nation. The tribe committed to keeping the park open to the public.
Why There Is Still No Tribal Casino in Illinois
The tribe says it does not want one
Chairman Joseph “Zeke” Rupnick has said repeatedly and publicly that a casino makes no sense on the site, citing the lack of transportation infrastructure and the fact that it would compete directly with existing casinos in Rockford and Aurora.
Illinois law stands in the way
A 2005 state statute requires the governor to obtain legislative approval before entering into a compact authorizing a tribe to conduct gaming in Illinois. Under the federal Indian Gaming Regulatory Act, Class III casino gaming, which includes blackjack, requires a tribal-state compact. Illinois has none.
It would not produce online blackjack anyway
Under federal law, wagers in tribal gaming must be placed and received on Indian lands. A compact could put blackjack tables in DeKalb County. It could not put them on a phone in Peoria.
The Wind Creek Distinction
Tribally owned is not tribal gaming
Wind Creek Chicago Southland in East Hazel Crest, which opened in November 2024, is operated by the Poarch Band of Creek Indians, an Alabama tribe. It is not a tribal casino. It holds an ordinary Illinois commercial casino owners license, is regulated by the Illinois Gaming Board and pays Illinois gaming taxes like every other casino in the state.
When Will Online Blackjack Become Legal in Illinois?
Not in 2026. Possibly in 2027 or 2028. Anyone who tells you they know is guessing.
What the 2026 Bill Would Have Done
House Bill 4797 was a full Internet Gaming Act. It would have let the Illinois Gaming Board license internet gaming operators, defining internet games as online versions or substantial equivalents of casino-style gambling, explicitly including slot-style games, table games, poker and live dealer simulcasts. The Case for Legalization
Money, mostly. Illinois faced a projected deficit in the billions heading into the fiscal 2026 budget, and supporters have put the annual revenue potential of a regulated Illinois iGaming market at around $800 million. Given the size of the state’s population and the scale of its existing sports betting handle, Illinois would immediately become one of the largest online casino markets in the country.
There is also a consumer protection argument that has gained traction. The February 2026 Cease-and-Desist Campaign
On Feb. 4 and 5, 2026, the Illinois Gaming Board, working with Attorney General Kwame Raoul’s office, issued 65 cease-and-desist letters ordering platforms to immediately block Illinois residents and stop awarding prizes in the state. The letters warned of civil or criminal penalties for noncompliance.
The named list ran to dozens of brands, including Chumba Casino, LuckyLand Slots, LuckyLand Casino, Global Poker, Stake.us, Pulsz, High 5 Casino, McLuck, WOW Vegas, Crown Coins, Fortune Coins, Modo, Fliff, Funrize, Legendz, Spree Casino, RealPrize, Zula Casino, Sixty6, Shuffle.us, Mega Bonanza, JefeBet and Jumbo 88.
A typical letter cited a specific observation date. The letter to Chumba Casino, for example, stated that on Jan. 12, 2026, the board observed the platform offering Illinois users slots, bingo and table games with the opportunity to win cash, gift cards and other prizes.
Almost Nobody Complied
Within two weeks, exactly two of the 65 named operators had restricted Illinois access: JefeBet and Jumbo 88. That is a compliance rate of roughly 3 percent, one of the lowest recorded in any state’s sweepstakes enforcement campaign. For comparison, New York’s attorney general reported full compliance from a similar round of letters, and Pennsylvania’s board got full compliance from 18 letters in 2025.
The reason is structural. A cease-and-desist letter is a demand, not a court order. Ignoring one forces the state to bring civil or criminal proceedings, which is expensive and slow, and it would require an Illinois court to rule for the first time on how the state’s gambling statutes apply to the sweepstakes model. The operators appear to have made a deliberate collective decision to make Illinois litigate it.

The Chicago Casino Situation
Bally’s has operated its temporary Chicago casino at Medinah Temple since September 2023 while building a permanent property in River West on the former Chicago Tribune printing plant site. Federal

Starting with the 2026 tax year, a federal change caps the gambling loss deduction at 90 percent of losses, still limited to the amount of winnings and still requiring you to itemize on Schedule A. Illinois allows no loss deduction at all
The critical point, and the one that surprises people: Illinois does not allow a deduction for gambling losses. Not partially, not up to winnings. Not at all. You can deduct losses federally if you itemize, but the state taxes your gross winnings. Illinois residents who win out of state can claim a credit on Schedule CR for taxes paid to another state.
